RESOLUTION NO. 98-141
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 13, CEDAR HILLS
RANCHES, AMENDED, IN SECTION 29, TOWNSHIP 21 NORTH, RANGE 14 WEST, FOR A
WIRELESS COMMUNICATIONS FACILITY WITH A 250-FOOT TOWER AND RELATED
EQUIPMENT IN A C-2H/8A (GENERAL COMMERCIAL HIGHWAY FRONTAGE/EIGHT ACRE
MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave Cotmty Board of Supervisors held on April 6,
1998, a public heating was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Communications Systems Development (CSD), Inc., of Stockton,
California, and
WHEREAS, this property is located north of Interstate 40 and west of the Blake Ranch Road
Interchange. The site is accessed from interstate 40 via north on Blake Ranch Road to Kathy Road, then
west and northwest on Kathy Road approximately 500 feet to an access road, then southwest to the site,
located approximately 800 feet southwest of Kathy Road. The property is vacant except for an off-premise
sign located approximately 700 feet west of the proposed tower location, and slopes slightly to the west.
The surrounding land uses consist of vacant land to the north and west, and Interstate 40 to the south. There
is a track stop with associated buildings to the east. There are no significant drainage patterns, and
WHEREAS, the applicant requests tiffs Zoning Use Permit for a wireless communications facility
with a 250-foot tower and related equipment in a C-2H/8A (General Commercial Highway Frontage/Eight
Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as a Rural
Development Area and an Outlying Community, and
WHEREAS, a review of FEMA FIRM Panel #040058~2375B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave Count)' General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a wireless communications facility with a 250-foot tower and
related equipment in a C-2H/8A (General Commercial Highway Frontage/Eight Acre
Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. The appropriate zoning, building, enviromnental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Pemait is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
Commission and outlined herein.
