P PAGE 05/08/98 ~' ~ "~ MOHAVE COUNTY ~OARD OF RECOROlNG FEE RESOLUTION NO. 98-142 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF GOVERNMENT LOTS 7 AND 10, IN THE W½ NE¼ OF SECTION 5, TOWNSHIP 20 NORTH, RANGE 17 WEST, FOR A WIRELESS COMMUNICATIONS FACILITY WITH A 195-FOOT TOWER AND RELATED EQUIPMENT IN A C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Communications Systems Development (CSD), Inc., of Stockton, California, and WHEREAS, this property is located north of Interstate 40 and north of the McCounico Interchange. The site is accessed from Interstate 40 via north at the McConnico exit to Oatman Road, then northeast on the Frontage Road to the site, located approximately one mile northeast of the Shinarump Drive and Oatman Road intersection. The property has a single-family residence on it and the terrain slopes to the southeast. The surrounding land uses consist of vacant land, two single-family residences, and several commercial businesses along the Frontage Road. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Pemfit for a wireless communications facility with a 195-foot tower and related equipment in a C-2H (General Commercial Highway Frontage) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. '~ FEE~?8~;. 2'?:_ RESOLUTION NO. 98-142 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a wireless communications facility ,vith a 195-foot tower and related equipment in a C-2H (General Commercial Highway Frontage) zone and activities related thereto. 2. The applicant shall comply with ail applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
