HomeMy WebLinkAbout98-144 OF'F]~CIAL RE.ORDS OF MOHAVE COUHiY, ~.~ JOAN MC CALL~ HOHAVE COUNTY ,.E..,R,E 04/08/98 02~22P PAGE i ~¥' '2 HOHAVE COUNTY gUARD OF RECORDING FEE r~.-- RESOLUTION NO. 98-144 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SOUTHERN PORTION OF THE N~¥¼ SW¼ OF SECTION 23, LYING WESTERLY OF US HIGI-IVqAY 93, IN TOWNSHIP 17 NORTH, RANGE 13 WEST, FOR AN OFF-PREMISE SIGN IN A C-MO/SA (COMMERCIAL- MANUFACTURING/OPEN LOT STORAGE/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the reguIar meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Cato L. Jones, Vice President of Jones Outdoor Advertising, Inc., Tucson, Arizona, and WHEREAS, this property is located on the west side of US Highway 93, approximately nine and one-half miles north of Wikieup, Arizona. The site is accessed directly from US Highway 93. The property has a towing service and a vehicle impound storage yard on it. The terrain of the surrounding property is gently rolling hills, with several residences to the west. The remaining property is vacant. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant proposes this Zoning Use Permit to allow an off-premise advertising sign (10' x 32' x 22' tall), on the southern part of this parcel. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2750B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the maximum sign area is two hundred fifty (250) square feet. Mohave County Zoning Regulations, Section 31-7-D-3a, allows the Commission and Board to approve a larger area sign on US Highway 93 and it states, "In all cases, off-premise signs shall have a maximum sign area of two hundred fifty (250) square feet, except on US Highway 93 and Interstate 40 and certain arterials where the Board of Supervisors designates a more restrictive maximum sign area. Off-premise signs with a total area not to exceed six hundred seventy-two (672) square feet, or 14' x 48', may be allowed on Interstate 40 and US Highway 93", and WHEREAS, the proposed location meets the zoning and spacing requirements for an off-premise sign. The Arizona Department of Transportation (ADOT) requires the off-premise sign to be located within 1,000 feet of an established commercial business. The nearest off-premise signs are located in the Outlying Community of Wikieup and at the intersection of US Highway 93 and 'Old Highway 93'. In addition, there are several on-premise signs between this location and Wikieup, including two in Wikieup, and Ol: 2 740 RESOLUTION NO. 98-144 Page 2 WHEREAS, on October 2, 1995, the Board of Supervisors denied a Zoning Use Permit for an off- premise sign on the same location with BOS Resolution No. 95-424, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended, but the use is inconsistent with the surrounding land uses and terrain. d. The neighboring area does not contain other like land uses similar to the above-proposed action. The nearest off-premise signs are located 9.1 miles to the south in the Outlying Community of Wikieup and at the intersection of US Highway 93 and 'Old Highway 93'. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 1 l, 1998, the Commission recommended DENIAL for a Zoning Use Pemtit on the southern portion of the NW¼ SW¼ of Section 23, lying westerly of US Highway 93, based upon the following: 1. The opposition from the surrounding property owners. 2. This sign will have adverse effects upon the scenic views of the surrounding property owners and is incompatible with the surrounding land uses. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, DENIED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~'~~//~'~"~.
