RESOLUTION NO. 98-148
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE S~ SE~A
OF SECTION 34, LYING SOUTHERLY OF THE INTERSTATE 40 FRONTAGE ROAD,
TOWNSHIP 21 NORTH, RANGE 17 WEST, FOR AN ANTIQUE STORE AND SWAP MEET IN
A C-MO/4A (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE/FOUR ACRE
MINIMUM LOT SIZE) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Maya Ivy and Guy Bowder of Golden Valley, Arizona, and
WHEREAS, this property is located south of Interstate 40 and northeast of the McConnico
Interchange. The site is accessed from Interstate 40 via the McConnico Interchange to the south Frontage
Road, then northeast on the Frontage Road to the site, located on the southeast side approximately two miles
northeast of the McConnico Interchange. The property has an existing building on it and the terrain is
relatively flat, sloping to the west. The surrounding land uses consist of vacant property and several
roadside businesses along the Frontage Road and the railroad to the south. There are no significant drainage
patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for an antique store and swap meet in
a C-MO/4A (Commercial-Manufacturing/Open Lot Storage/Four Acre Minimum Lot Size) zone. The
Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. Tiffs Zoning Use Permit is for an antique store and swap meet in a C-MO/4A (Commercial-
Manufacturing/Open Lot Storage/Four Acre Minimum Lot Size) zone and activities related
thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. A six-inch City of Kingman water line is located in this vicinity according to water maps.
Since this is an unsubdivided parcel, any application for new water service will require a
review by the City Municipal Utilities Commission (MUCH) and approval by the City
Council.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
