HomeMy WebLinkAbout98-150 RESOLUTION NO. 98-150 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 16, BLOCK 121, NEW KINGMAN ADDITION, UNIT 8, TRACT 1101, IN SECTION 30, TOWNSHIP 22 NORTH, RANGE 16 VCEST, FOR A RETAIL NURSERY IN A C-1 (NEIGHBORHOOD COMMERCIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Linda A. Quevedo of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road and north of Northern Avenue. The site is accessed from Stockton Hill Road via east on Northern Avenue to North Roosevelt Street, then north on North Roosevelt Street to Butler Avenue, then east on Butler Avenue to the site, located on the south side approximately 210 feet east of North Roosevelt Street. The property is vacant, has a chain link fence around it and is relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant lots and single-family residences to the north. There are businesses on the south side along Northern Avenue. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a retail nursery in a C-1 (Neighborhood Commercial) zone. The Mohave County General Plan designates this area as an Urban Development Area. This property was rezoned to C-1 (Neighborhood Con'nnercial) zone on February 2, 1998, via BOS Resolution No. 98-76, and WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. RESOLUTION NO. 98-150 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conmfission on March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a retail nursery in a C-1 (Neighborhood Commercial) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The applicant will provide a view-obscuring fence along property line with the residential zoned property on either side of this lot. 4. The existing Public Utility Easements (PUE) along the rear lot lines cannot be pem~anently blocked. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 6. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontim~ed for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
