HomeMy WebLinkAbout98-157 RESOLUTION NO. 98-157 A RESOLUTION SETTING FORTH A RECONSIDERATION OF A ZONING USE PERMIT ON LOT 7, EXCLUDING THE NORTH 15 FEET, THE SOUTH 15 FEET AND THE WEST 30 FEET; AND LOT 16, EXCLUDING THE NORTH 15 FEET, THE SOUTH 30 FEET AND THE WEST 30 FEET, VALLEY SLOPE SUBDIVISION, IN SECTION 12, TOWNSHIP 21 NORTH, RANGE 17 WEST, FOR AN EQUESTRIAN BOARDING FACILITY IN AN A-R (AGRICULTURAL- RESIDENTIAL) ZONE, 1N THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to reconsider a Zoning Use Permit granted on February 2, 1998, for the above-described property as requested by Dorothy W. Fellows of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road and north of Interstate 40 west of the City of Kingman. The site is accessed from Stockton Hill Road via west on Sycamore Avenue to North Harvard Street, then south on North Harvard Street to Anson Smith Road, then west on Anson Smith Road to the site, located on the north side approximately 1,000 feet west of North Fourth Street. The property is vacant and rising to the north from Anson Smith Road. The surrounding land uses consist of vacant land and single-family residences. State of Arizona owns the land to the west. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an equestrian boardh~g facility in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this item was heard at the December 10, 1997, Planning and Zoning Commission meeting and was continued at the request of the applicant to allow her time to reach a reasonable compromise with her neighbors, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. RESOLUTION NO. 98-157 Page 2 d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 14, 1998, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. The proposed equestrian boarding facility is too large for this predominantly residential neighborhood. 2. The opposition from the surrounding property owners. WHEREAS, at their regular meeting on Monday, February 2, 1998, the Board of Supervisors held a public hearing and considered public testimony and APPROVED this Zoning Use Permit, via BOS Resolution No. 98-77, subject to the following: 1. This Zoning Use Permit is for an equestrian boarding facility and activities related thereto. No more than fifty (50) horses shall be kept at the facility. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed mad approved prior to approval of permits. The applicant shall revise the proposed parking so that vehicles leaving the parking stalls do not back onto Anson Smith Road. 3. The applicant shall remove the manure from the site daily. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 98-157 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, RECONSIDERED and DENIED this Zoning Use Permit as had been recommended by the Mohave County Planning and Zoning Conunission on January 14, 1998, and outlined herein.
