A RESOLUTION SETTING FORTH A REZONE OF LOT 31, EXCEPT THE NORTH 215.12
FEET, BLOCK B, FORT MOHAVE MESA RANCHOS, IN SECTION 26, TOWNSHIP 19 NORTH,
RANGE 22 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO R-M (MULTIPLE-
RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Don R. and Nancy Matuzak of Fort Mojave, Arizona, and
WHEREAS, this property is located east of State Highway 95, between Joy Lane and E1 Rodeo
Road. The site is accessed from State Highway 68, via east on Joy Lane to the site, located on the northeast
comer of Joy Lane and Calle del Media. The property has a single-family residence and several accessory
buildings on it and the terrain is relatively flat, sloping very slightly to the west toward the Colorado River.
The surrounding land uses consist of vacant lots, an elementary school to the south, a day-care center to the
east, and scattered single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for commercial development and (4)
four-plexes. The applicant proposes to divide the 1.81-acre parcel into four lots for four-plexes ranging in
size from 11,000 square feet to 17,655 square feet, and one lot for commercial purposes of 19,450 square
feet. The Mohave County General Plan designates this area as an Urban Development Area. There is
commercial-zoned property to the west and southwest toward State Highway 95 and Multiple-Residential-
zoned property to the northwest, and
WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
fi There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Platming and Zoning Commission on
April 8, 1998, the Corrunission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned R-M/10M (Multiple-Residential/Ten Thousand Square Foot
Minimum Lot Size) as shown on Exhibit "A." No more than five parcels may be created.
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. An additional 1 O-foot of road fight-of-way along the western boundary for Calle del Media,
and an additional 12-foot of road right-of-way along the southern boundary for Joy Lane,
shall be dedicated to the public and accepted by the Mohave County Board of Supervisors.
In addition, a 20-foot radius curve is required at the dedicated roadway intersection point of
Calle del Media and Joy Lane.
4. The eight feet adjoining to all road rights-of-way shall be granted to the public as a Public
Utility Easement (PUE).
5. Mohave Electric Cooperative (MEC) has an overhead power line located along the eastern
boundary of this property; any buildings shall be at least eight (8) feet from the east property
line.
6. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
7. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
8. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
9. Each parcel shall have legal access.
10. The applicable flood zone(s) shall be noted on the Parcel Plat.
11. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
12. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.

13. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supervisors approval, this rezone approval will be void.
All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and applicant who requested the rezoning) shall schedule a public hearing to grant
an extension, detemaine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
WHEREAS, at their May 4, 1998 meeting, the Board of Supervisors received input from area
residents about concerns with traffic and the impact to the school.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, DENIED this Rezone for the following reason:
1. The development will increase traffic across from the elementary school, creating safety
concerns for the school children.
