HomeMy WebLinkAbout98-170 " ~ OFFICIAL RECORDS OF ~OHAVE COUNTY, ~ ,'OAN MC CALL, M O HAVE COUNTY RE(O2D 05/08/9~ J2:lgP PAGE i OF 2 MOHAVE COUNTY BOARD OF SOPERV):SDRS ~ RECORDING FEE RESOLUTION NO. 98-170 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE E~ OF LOT 16, BLOCK G, GOLDEN SAGE RANCHOS, UNIT 65, IN SECTION 9, TOWNSHIP 21 NORTH, RANGE 18 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Arlene L. and Michael T. Smith of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68, between Verde Road and Adobe Road. The site is accessed from State Highway 68, via north on Verde Road to Chino Drive, then east on Chino Drive to the site, located on the south side between McNeal Road and Magma Road. The property has a single-family residence and a travel trailer on it. The surrounding land uses consist of vacant lots and single-family residences. There is a drainage wash running along the west side of this property from the north to the south, and WHEREAS, the applicant requests this Zoning Use Permit to allow a mobile home as a secondary residence in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, this action is to correct a violation of the Mohave County Zoning Regulations, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. F'RGE 2 OF' 2 Bt'-', ~0~,~ F'(~ 2,[~ ':'--r:~"~ '"~'~":' RESOLUTION NO. 98-170 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 8, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall temrinate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
