RESOLUTION NO. 98-171
A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 90-65 AND
94-212 WHICH APPROVED THE REZONE AND THE EXTENSIONS OF TIME FOR THE
REZONE FOR PARCEL 264, IN SECTION 11, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN
THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine ~vhether approval should be granted for the Rescission
of the Resolutions for the Rezone and the Extensions of Time for the Rezone for the above-described
property as requested by the Planning and Zoning Department, and
WHEREAS, this property is located south of State Highway 68, between Estrella Road and Laguna
Road. The site is accessed from State Highway 68 via south on Estrella Road to the site, located on the
northeast comer of Estrella Road and Shipp Drive. The property is vacant and the terrain is relatively flat,
sloping slightly to the southeast. There are no significant drainage patterns, mad
WHEREAS, this property was conditionally approved for a rezone to R-M (Multiple-Residential)
by the Mohave County Board of Supervisors on March 5, 1990, via BOS Resolution No. 90-65. The only
Extension of Time was approved on July 5, 1994, with BOS Resolution No. 94-212. None of the conditions
of approval for BOS Resolution No. 90-65 have been completed; hence, the R~M zoning has never been
vested. The zoning for the property remains A-R/10A. A letter was sent informing the property owner that
it would be scheduled for rescission. The Mohave County General Plan designates this area as an Urban
Development Area, and
WHEREAS, on November 10, 1994, Parcel 264 was divided via Record of Survey Book 12, Page
32, creating Pazcel 264-A, a 10-acre parcel on the western 330 feet of Parcel 264; and 264-B, a 29.99-acre
parcel on the remainder of Parcel 264. On June 2, 1997, Parcel 264-B was rezoned with BOS Resolution
No. 97-183 creating four one-acre parcels mad one 23.2-acre parcel and dedicating the roadway easements
to the public, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site has legal access.
d. There are no significant environmental features affecting the site, except being in a Special
Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 8, 1998, the Conunission recommended APPROVAL for the Rescission of BOS Resolution Nos. 90-
65 and 94-212 and the zoning for the western 330 feet of Parcel 264 to revert to A-R/10A (Agricultural-
Residential/Ten Acre Minimum Lot Size).
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, APPROVED the Rescission of B OS Resolution Nos. 90-65 and 94-212 and the
zoning for the western 330 feet of Parcel 264 reverting to A-R/10A (Agricultural-Residential/Ten Acre
Minimum Lot Size) as recommended by the Mohave County Plamfing and Zoning Commission and outlined
herein.
