RESOLUTION NO. 98-172
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 40-FOOT ACCESS ROAD
LOCATED BETWEEN CHEA DRIVE AND PARK AVENUE, IN SO-HI ESTATES, UNIT ONE,
AMENDED, IN THE SW¼ OF SECTION 31, TOWNSHIP 22 NORTH, RANGE 17 WEST IN THE
SO-HI PORTION OF THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine whether approval should be granted to abandon the
above-described roadway easement as requested by Martin A. Colbaugh and Robert W. Braun of Golden
Valley, Arizona, and
WHEREAS, this property is located east of State Highway 93 between Chea Drive and Park
Avenue. The site is accessed from State Highway 93, via east on Chea Drive. The terrain is relatively flat
and slopes slightly toward the southwest. The surrounding land uses consist of vacant parcels and several
single-family residences. There are no significant drainage patterns, and
WHEREAS, the Mohave County Depaxtment of Public Works does not object to the abandonment
of the access road, yet does request that 42 feet along the section line for Sunset Drive, aka Sundown Drive,
will be dedicated to the public as a roadway right-of-way between Chea Drive and Park Avenue. The
applica~nts have recorded a 20-foot access road along Sunset Drive. No part of Chea Drive or Park Avenue
may be included in the abandoun~ent, and
WHEREAS, the So-Hi Water Improvement District currently uses the easement; they have been
provided with a new easement, executed on March 4, 1998, and do not object to the abandonment. The
easement is currently used by Citizens Utilities Company. The existing power line will be relocated in a
new easement. This easement was executed on March 4, 1998. Citizens Utilities Company does not object
to the abandonment, and
WHEREAS, a review of FEMA FIRM Panel #040058-2150B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended.

d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 8, 1998, the Commission recommended APPROVAL for the Abandonment subject to the following:
1. A 30-foot road right-of-way along the section line for Sunset Drive between Chea Drive and
Park Avenue shall be dedicated to the public and accepted by the Mohave County Board of
Supervisors. This may be done by separate instrument.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998 mad April 25, 1998, and posted April 17,
1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
