A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NORTH 727.65 FEET
OF THE EAST 609.00 FEET OF THE SE¼ OF SECTION 13, EXCLUDING THAT PORTION OF
LAKE HAVASU ESTATES MOHAVE CENTER, UNIT 1, TRACT 1168, IN TOWNSHIP 17
NORTH, RANGE 18 WEST, FOR A WIRELESS COMMUNICATIONS FACILITY WITH A 250-
FOOT TOWER AND RELATED EQUIPMENT IN AN A-R (AGRICULTURAL-RESIDENTIAL)
ZONE, IN THE YUCCA PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Communications Systems Development (CSD), Inc., of Stockton,
California, and
WHEREAS, this property is located east of Interstate 40 and south of the Alamo Road Exit. The
site is accessed from Interstate 40 via east on Alamo Road to Mohave Center Boulevard, then south on
Mohave Center Boulevard to the site, located approximately 500 feet south of Stephens Drive. The property
is vacant and the terrain is gently rolling hills flowing to the southwest. The surrounding land uses consist
of vacant land and several single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a wireless conununications facility
with a 250-foot tower and related equipment in an A-R (Agricultural-Residential) zone. The Mohave
County General Plan designates this area as a Rural Development Area and Yucca is an Outlying
Community, and
WHEREAS, a review of FEMA FIRM Panel #040058-1975B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the sun'ounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conmnission on
April 8, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a wireless communications facility with a 250-foot tower and
related equipment in an A-R (Agricultural-Residential) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not conm~enced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
