RESOLUTION NO. 98-177
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 69-C, AS SHOWN
ON PARCEL PLATS BOOK 6, PAGE 13, A PORTION OF PARCEL 69, DIAMANTE ACRES, A
SUBDIVISION OF SUNWARD HO! RANCHES, IN SECTION 7, TOWNSHIP 22 NORTH, RANGE
16 WEST, FOR A DOG KENNEL IN AN A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE
MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Eula S. Bascle of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road and north of the City of Kingman.
The site is accessed from Stockton Hill Road via east on Cactus Wren Road to Cherum Road, then north
on Chemm Road to Calle Castano, then east on Calle Castano to Avenida Ramirez, then south on Avenida
Ramirez to the site, located on the east side approximately 800 feet south of Calle Castano. The property
has two mobile homes and a dog kennel on it and is relatively flat, sloping slightly to the southeast. The
surrounding land uses consist of vacant lots and a few widely scattered single-family residences. There are
no residents adjacent to this property; the nearest single-family residence is over one-quarter mile away to
the west and north. There is a wash crossing the property from the western boundary to the southern
boundary in the southwest corner. There are no other significant drainage patterns noted, and
WHEREAS, the applicant requests this Zoning Use Permit for a dog kennel in an A-R/5A
(Agricultural-Residential/Five Acre Minimmn Lot Size) zone. The Mohave County General Plan designates
this area as a Suburban Development Area; the Long Mountain Ama Plan designates this area as R-R/5A
(Rural Residential/Five Acre Minimum Lot Size), and
WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, on August 13, 1997, the Planning and Zoning Commission recommended approval
for the Zoning Use Permit for the dog kennel. On September 2, 1997, the Mohave County Board of
Supervisors, via BOS Resolution 97-327, denied the Zoning Use Permit on this property for a dog kennel
due to opposition from area residents and the poor health of the animals, and

WHEREAS, the Planning and Zoning Department requested that the Mohave Connty Department
of Health &Social Services, Environmental Health Division, and the Mohave County Animal Control
inspect the applicant's operation. Both reports indicate that the applicant is operating her kennel well within
standards. The dogs appear to be well cared for and the kennels are being kept clean, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the Long
Mountain Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant envirorm~ental features affecting the site, except the noted Special
Flood Hazard Area and the wash crossing the property from the western boundary to the
southern boundary in the southwest corner.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Comrnission on
April 8, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a dog kennel and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
