A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 9%398
SETTING FORTH A REZONE OF PARCEL 35-H, AS SHOWN ON RECORD OF SURVEY BOOK
12, PAGE 83, VOCK CANYON RANCHES, NUMBER 2, AMENDED, IN THE SE¼ OF SECTION
35, TOWNSHIP 24 NORTH, RANGE 17 WEST, FROM A-R/36A (AGRICULTURAL-
RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A AND A-R/14A
(AGRICULTURAL-RESIDENTIAL/FIVE ACRE AND FOURTEEN ACRE MINIMUM LOT SIZE)
ZONES, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 97-398,
setting forth a Rezone, should be granted for the above-described property as requested by Rand W.
Holmquist, RLS, of Kingman, Arizona, representing U. Kelly Lusk of Hualapai, Arizona, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been struck,
and
WHEREAS, this property is located north of Kingman and west of Stockton Hill Road. The site
is accessed from Stockton Hill Road via west-southwest on Vock Canyon Road approximately one and one-
quarter miles to the site, which is on the south side of Vock Canyon Road. The property is vacant. The
southern portion of the property lies on the northern slope of a mountain and the northern portion of the
property is gently rolling hills sloping north. The surrounding land uses consist of vacant parcels. There
are no significant drainage patterns, and
WItEREAS, the applicants request this Amendment to BOS Resolution No. 97-398, approving
a Rezone, to correct the acreage as shown on Record of Survey Book 12, Page 83, which stated the
acreage to be 47.071 acres. During the survey for the Parcel Plat, as required by the rezone action,
Mr. Holmquist discovered that the Record of Survey overstated the acreage by approximately seven
acres. Mr. Holmquist requests that the two parcels be rezoned A-R/10A (Agricultural-Residential/
Ten Acre Minimum Lot Size), and
WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2000B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public heating before the Mohave Comity Planning and Zoning Commission on
April 8, 1998, the Commission recommended APPROVAL of the proposed Amendment to BOS Resolution
No. 97-398 setting forth a Rezone subject to the following:
1. The northern three parcels will be rezoned A-R/5A (Agricultural-Residential/Five Acre
Minimum Lot Size) and the southern two parcels will be rezoned ~

Acre Minimum Lot Size). No more than five parcels will be created.
2. The submittal and recordation of a Parcel Plat prepared in accordance ~vith Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The Board of Supervisors accepts the dedication of the existing 35-foot roadway easement
known as Vock Canyon Road and the proposed cul-de-sac at a width of 50 feet, complete
with a 45-foot radius bulb terminus, as road rights-of-way.
4. The eight feet adjoining all rights-of-way shall be granted to the public as a Public Utility
Easement (PUE).
5. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA flood zones.
9. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.

10. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.
11. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supervisors approval, tlfis rezone approval will be void.
All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and applicant who requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, APPROVED this Amendment to BOS Resolution No. 97-398 setting forth a
Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
