RESOLUTION NO. 98-179
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 3 AND 4, BLOCK 175,
NEW KINGMAN ADDITION, UNIT 10, TRACT 1103, IN SECTION 30, TOWNSHIP 22 NORTH,
RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN R-1 (SINGLE FAMILY
RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Darrell L. and Karyl B. Kalina of Placerville, California, and
WHEREAS, this property is located north of Northern Avenue, between Stockton Hill Road and
North Bank Street. The site is accessed from Stockton Hill Road via east on Northern Avenue to North
Lomita Street, then north on North Lomita Street to Devlin Avenue, then west on Devlin Avenue to the site,
located on the south side approximately 150 feet west of North Lomita Street. The property has a single-
family residence and a garage with living quarters in it. The surrounding land uses consist of single-family
residences and vacant lots. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an R-1
(Single Family Residential) zone. The area of these two lots is 13,000 square feet. The Mohave County
General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this action is to correct a violation of the Mohave County Zoning Regulations, and
WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on March
11, 1998, and was continued so that the Zoning Department could measure the location of the structures on
this property. On March 12, 1998, the Senior Zoning Inspector measured the structures on this property and
determined that the mobile home is on both lots, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public heating before the Mohave County Plauning and Zoning Commission on
April 8, 1998, the Conmfission recommended DENIAL for a Zoning Use Permit based upon the following:
1. Section 27.R-1 .c (Accessory or Secondary Residence Requirements) Site Plan Conditions
require that for lots less than one-half (0.5) acre, the Secondary Residence shall be attached
to or within the primary residence and have the same roof line. On this lot the secondary
residence is separate from the primary residence.
2. The Zoning Department measured the location of the structures on this property and
determined that the mobile home is on both lots.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, DENIED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
