RESOLUTION NO. 98-180
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 43, BLOCK D, LAKE
MOHAYE COUNTRY CLUB ESTATES, UNIT 3, AMENDED, IN SECTION 31, TOWNSHIP 22
NORTH, RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN R-1/20M (SINGLE
FAMILY RESIDENTIAL/TWENTY THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE,
IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4,
1998, a public hearing was conducted to detemfine whether a Zoning Use Permit should be granted for the
above-described property as requested by Rashida Hussain of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road, between Northern Avenue and
Sierra Vista Avenue. The site is accessed from Stockton Hill Road via east on Northern Avenue to North
Roosevelt Street, then south on North Roosevelt Street to the site, located approximately 900 feet south of
Northern Avenue. The property has a single-fmnily residence on it and the terrain is relatively flat, sloping
slightly to the southeast. The surrounding land uses consist of vacant lots and single-fanfily residences.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence for their
parents in an R-1/20M (Single Family Residential/Twenty Thousand Square Foot Minimmn Lot Size) zone.
The Mohave County General Plan designates this ar'ea as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the folloMng described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant enviromnental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 8, 1998, the Commission recommended DENIAL for a Zoning Use Permit based upon the following:

1. The applicant is operating a Licensed Adult Care Center on this property and a secondary
residence is not intended for this purpose.
2. The objections of the surrounding property owners.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
cimulation in Kingman, Mohave County, Arizona, April 18, 1998, and posted on April 17, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 4, 1998, DENIED this Zoning Use Permit as recommended by the Mohave County
Plam~ing and Zoning Commission and outlined herein.
