WHEREAS, the Board of Supervisors of Mohave County met in Regular Session this 4t~ day
of May, 1998, and
WHEREAS, certain health, safety and public welfare responsibilities are delegated by the
State to Mohave County Board of Supervisors, and
WHEREAS, the State Legislature has directed that a State Plumbing Code shall be developed
by a State Plumbing Code Commission appointed by the Governor; and
WHEREAS, the State Plumbing Code Commission has proposed adopting into rule, a code
indicating the State Plumbing Code Commission's Administrative Authority over the design and
construction of on-site private sewage systems; and
WHEREAS, adoption of such code will be in direct conflict with existing Arizona Statutes
designating the Arizona Department of Enviroumental Quality as the Administrative Authority over
private sewage systems; and
WHEREAS, the proposed code is based on outdated and inadequate standards; and
WHEREAS, all Arizona Counties approve and administer private sewage systems in
accordance with standards specified by Arizona Department of Enviro~m~ental Quality Engineering
Bulletins; and
WHEREAS, adoption of the code as proposed by the State Plumbing Code Commission may
severely harm the environment, reduce property values and impair property development in rural
areas; and
WHEREAS, the rural areas of the state are inadequately represented on the State Plumbing
Code Commission; amd
WHEREAS, the Arizona Department of Enviroumental Quality is empowered by statute and
possesses the necessary expertise to effectively and adequately act as the administrative authority
over private on site sewage systems, design, standards, construction, treatment, disposal, or reuse
systems.
NOW, THEREFORE, BE IT RESOLVED, that the Mohave County Board of Supervisors
opposes the promulgation of any rule proposed by the State Plumbing Code Commission which
designates the State Plumbing Code as the Administrative Authority over private sewage systems,
or which proposed any standards or requirements pertaining to the design or construction of private
on-site sewage storage, treatment, disposal, or reuse systems or equipment.
BE IT FURTHER RESOLVED, that the Mohave County Board of Supervisors calls upon
the Governor, the President of The State Senate and Speaker of The State House of Representatives
Resolution No. 98-185

to oppose the promulgation of any Rule proposed by the State Plumbing Code Commission which
designates the State Plumbing Code commission as the Administrative Authority over private on-site
sewage storage, treatment, disposal, or which proposes any standards or requirements pertaining to
the design or construction of private on-site sewage storage, treatment, disposal, or reuse systems
or equipment.
PASSED, APPROVED, AND ADOPTED this 4th day of May, 1998.
