HomeMy WebLinkAbout98-198 INDEXED rC OFI[M U OFFICIAL RECORDS OF MOHAVE COUNT% AZ JOAN MC CALL~ MOHAVE COUNTY RECORDER MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 98-198 A RESOLUTION SETTING FORTH A REZONE OF THE EASTERLY 150 FEET OF THE SOUTHERLY 509.56 FEET OF THAT PORTION OF THE NW¼ SW¼ SW¼ OF SECTION 21, LYING EASTERLY OF LONDON BRIDGE ROAD AND SOUTHERLY OF LAKE DRIVE, EXCLUDING THE NORTHERLY 100 FEET OF THE EASTERLY 100 FEET, IN TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM R-1 (SINGLE FAMILY RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the aboYe- described property as requested by Romer C. and Cathy Jo Blackmun of Lake Havasu City, Arizona, and WHEREAS, this property is located east of London Bridge Road (Old State Highway 95) and south of Lake Drive. The site is accessed from State Highway 95 via west on Lake Drive to the site, located on the south side of Lake Drive, approximately 100 feet east of London Bridge Road. The property is vacant and the terrain is relatively flat, sloping to the southwest toward the Colorado Privet and Lake Havasu. The surrounding land uses consist of general commercial businesses along both sides of London Bridge Road to the north, a mobile home park to the east, and vacant property. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for commercial development. This property was rezoned on February 20, 1969, via P&ZC Resolution No. 69-47, with the property adjacent to London Bridge Road being zoned to C-2 (General Commercial) and the easterly 150 feet o£this property was rezoned to R-1 (Single-Family Residential). The applicant proposes to rezone the eastern 150 feet so that the entire property is zoned the same, C-2 (General Commercial). The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-311 OB indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on April 8, 1998 and was continued at the request of the applicant, and F'$'~GE 2 OF ~ BK 3098 F'6 730 FEE,,-%0,~,~,.~ RESOLUTION NO. 98-198 Page 2 WHEREAS, the surrounding zoning along London Bridge Road is mostly C-2 (General Commercial) and C-2H (General Commercial Highway Frontage). There are two C-RE (Commercial- Recreation) lots, several R-1 (Single-Family Residential) lots and one R-E (Residential-Recreation) lot. The property to the east in LAKE HAVASU MOBILE HOME PARK, Tracts Number 1068, 1077, and 1082, is zoned R-MH (Single Family Residential Mobile Home), and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohav¢ County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-2 (General Commercial). 2. The applicant shall comply with ail applicable provisions of the Mohave County Zoning Regulations. Upon development Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. The applicant shall provide right-of-way, road, and drainage improvements as required by the Mohave County Engineer prior to site plan approval. 3. The applicant shall construct a 6'-0" CMU wall along the rear property line to separate the residential area from the commercial area. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. F',~SE ~ OF ~ Bt'{ 30?8 Pti 7~1 FEE~-S'80~224g RESOLUTION NO, 98-198 Page 3 WHEREAS, the notice of hearing was published in The Standm'd, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 16, 1998, and posted on May 15, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
