WHEREAS, the State of Arizona has, in Arizona Revised Statutes Title 11, Chapter 2, Article 4, Section 11-251 (4), authorized the Board of Supervisors (hereinafter sometimes referred to as the "BOS") of Mohave County, a body politic and corporate of the State of Arizona, (hereinafter "Mohave County"), amongst other things, to layout, maintain, control and manage public roads; and WHEREAS, Mohave County has roads that were constructed to County Standards and receive regular maintenance under the provisions of Arizona Revised Statutes Title 28, Chapter 19, Article 1, Sections 28-6705 or 28-6707; and WHEREAS, the State of Arizona, by the provisions of Arizona Revised Statutes Title 28, Chapter 19, Article 1, Section 28-6705, also allows counties to maintain public roads that were laid out, constructed, and opened prior to June 13, 1975, even if such roads and streets were not built in accordance with County Standards; and WHEREAS, Mohave County provides maintenance to some roads pursuant to AR.S. S 28-6705 including limited maintenance on some roads built prior to June 13, 1975, even when such pre- June 13, 1975 roads and streets were not built in accordance with County Standards and do not meet other post June 13, 1975 prerequisites for maintenance; and WHEREAS, the State of Arizona has provided authority to the Board of Supervisors to designate and sign as "Primitive Roads", public roads within its jurisdiction meeting the criteria of Arizona Revised Statutes Title 28, Chapter 19, Article 1, Section 28-6706; and WHEREAS, the Board of Supervisors has established a primitive roads classification and designated roads within Mohave County as primitive roads, by BOS Resolution No. 95-382; and WHEREAS, subsequent to BOS Resolution 95-382, some of the designated primitive roads since then have been designated by the Board of Supervisors as County highways, as is evidenced by Exhibit "A" attached hereto and incorporated herein by reference; and . RESOLUTION NO. 99- 489 Page 2 WHEREAS, Arizona Revised Statutes Title 28, Chapter 19, Article 1, Section 28-6706, provides that neither a state nor county highway shall be designated as a primitive road; and NOW, THEREFORE, BE IT RESOLVED that BOS Resolution 95-382 shall be amended, with the original primitive road classification list thereof being modified in accordance with Exhibit" B" attached hereto and incorporated herein by reference. Such amended list of designated primitive roads shall become effective on the day of adoption of this Resolution by the Board of SupeNisors; and BE IT FURTHER RESOLVED, that the Mohave County Public Works Department is authorized to cause such primitive roads to be signed, pursuant to the provisions of Arizona Revised Statutes, Title 28, Chapter 19, Article 1, Section 28-6706.
