RESOLUTION NO. 95-509
WHEREAS, the Board of Supervisors of Mohave County met in Regular Session this 4th
day of December, 1995, and
WHEREAS, pursuant to ARS 48-4001 Et Seq. the Board of Supervisors is authorized to
establish a jail district for the purpose of acquiring, constructing, operating, maintaining and
financing county jails and jail systems; and
WHEREAS, after the public hearing held for the purpose of hearing all persons in favor or
opposed to the establishment of a Jail District, it appears to the Board of Supervisors that the public
interest, convenience and necessity will be served by the formation of a Jail District, and
WHEREAS, after public hearing, it appears to the Board of Supervisors that the funding
mechanism best suited to the needs ofMohave County is an excise tax as provided for by ARS 48-
4021 and 48-4022; and
WHEREAS, establishment ofajail district is contingent upon approval of an excise tax by
a majority of qualified electors voting at the election;
WHEREAS, pursuant to ARS 48-4001 et seq, the Mohave County Board of Supervisors at
a Regular meeting held November 6, 1995, adopted Resolution No. 95-464 - Calling for the
establishment of the Mohave County Jail District, setting a date for hearing and calling a Special
District Election on March 12, 1995.
NOW THEREFORE, IT IS FOUND, RESOLVED, DETERMINED AND ORDERED AS
FOLLOWS:
1. That, after public hearing and due consideration, the Board of Supervisors finds that the
public interest, convenience and necessity of the citizens of Mohave County would be served
by the formation of a County-wide Jail District.
2. That, after public hearing and due consideration, the Board of Supervisors finds that the
appropriate form of funding for a jail district would be an excise tax pursuant to ARS 48-
4021 and 48-4022.
3. That the fonnation of a Jail District in Mohave County is ordered, contingent upon approval
of an excise ta'\. by a majority of qualified electors voting at the Special Election to establish
the district.

That the Jail District shall be known in all proceeding as the "Mohave County Jail District",
and the boundaries of the district shall be all ofMohave County, including the incorporated
and unincorporated areas.
5. That the revenues generated by the proposed excise tax will only be used for acquiring,

constructing, operating, maintaining and financing of a County jail and jail system.
6.
That the maximum rate of tax shall not exceed the limits prescribed in ARS 48-4022, and
that the number of years for which the proposed excise tax will be authorized is tW01ty
(20) years.
7.
That a Special Election is hereby called for March 12, 1996, pursuant to ARS 16-225, for
the fonnation of the Mohave County Jail District and authorization of a jail district excise
tax.
