RESOLUTION NO. 98-3
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF FAIRWAY VILLAGE, TRACT 4154, BEING A
SUBDIVISION OF GOVERNMENT LOT 2, AND A PORTION OF GOVERNMENT LOT 1,
SECTION 3, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY
AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1998, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by the developer and project engineer, Glen L Ludwig of Ludwig Engineering, Inc.,
San Bemardino, California, and
WHEREAS, the property is located approximately four miles south of Bullhead City. The property
is accessed via State Highway 95, immediately south of Lipan Boulevard and west one-tenth o£a mile to
the site, and
WHEREAS, the Prelimina~ Plan depicts 70 acres subdivided into 357 single-family residential lots
and one common parcel comaining 3.2 acres. The minimum residential lot size is 4,800 square feet. The
average residential lot size is 5,715 square feet, and
WHEREAS, the owner/developer has indicated in a letter dated October 16, 1997, that an Extension
of Time is being requested due to an economic downtm-n that has weakened the prospect for sales of lots
and homes in the subdivision, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on October 2, 1995, per BOS Resolution No. 95-404. Subdivision Regulation Article 3.10-1
states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in
increments of one (1) year may be granted by the Board o£ Supervisors if the subdivider is actively
processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be
terminated.", and
WltEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed. They have recommended that any
required changes or modifications will be the responsibility of the developer, and

WHEREAS, this will be the first Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request complies with the Extension of Time Policy based on the following: Though
neither a Final Plat nor improvement plans have been submitted for the processing of this
subdivision, the request for the Extension of Time was received less than 90 days after the
expiration of the original Preliminary Plan approval, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 10, 1997, the Commission reconunended APPROVAL of an Extension of Time for the
Preliminary Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution No. 95-404.
2. This Extension of Time will be in effect until October 2, 1998.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, January 5, 1998, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
