RECORDS OF MOHAVE COUi'U'% AZ JOAN M(: CALL, MOHAVE COUNTY RECORDER r~OHAVE COUNTY BOARD OF SUF'ERVISORS RECOROING FEE RESOLUTION NO. 98-2 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE E¼ E¼ NE¼ OF SECTION 5, TOWNSHIP 40 NORTH, RANGE 15 WEST, TO BE KNOWN AND SUBDIVIDED AS MOHAVE MEADOWS SUBDIVISION, TRACT 3509, FROM A-R (AGRICULTURAL- RESIDENTIAL) ZONE TO R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, IN THE ARIZONA STRIP AREA, MOHAYE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Keith L. Whittaker of St. George, Ut~th, and WHEREAS, this property is located north of Interstate 15 and east of County Highway 91. The site is accessed from County Highway 91 via east on Beaver Dam Drive to the site, located on the south side at the terminus of Beaver Dam Drive approximately three-tenths (0.3) mile southeast of County Highway 91. The property is vacant and relatively flat, sloping slightly to the southeast toward the Virgin River. The surrounding land uses consist of vacant land and Beaver Dana Estates, Tract 3034-A, subdivision is located to the northwest. The property is in proximity to the Beaver Dam Wash, mad WHEREAS, the applicant requests this zone change for the proposed MOHAVE MEADOWS SUBDIVISION, Tract 3509. The applicant proposes to divide the 3.281 acres into 11 single-fanfily residential lots. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-0025C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. ?AGE 2 OF 2 B,K ~022 PG 2 FEE~?8003372 RESOLUTION NO. 98-2 Page 2 WItEREAS, at the public heating before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: 1. A portion of the E½ E½ NE~A of Section 5, Township 40 North, Range 15 West, to be known and subdivided as MOHAVE MEADOWS SUBDIVISION, Tract 3509, will be rezoned to R-O (Single Family Residential/Mobile Homes Prohibited). 2. The rezone will be effective upon the recordation of the Final Plat of MOHAVE MEADOWS SUBDIVISION, Tract 3509, or the rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 3. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. 4. The appropriate zoning, building, environmental, and floodplain pemfits will be obtained prior to construction. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. WItEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in K/ngman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
