"'~:J1~~)~; ........ ,~ .;'f\'.q'. 98CII=1339~..i BK 3022 F'G "1 OFFICIAL RECORDS OF MOHAVE COUfHY, At. .JOAN MC CALL, MOHAVE COUNTY RECORDER 01/21/98 01:55P PAGE 1 OF 2 tlOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 98-5 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF DESERT LAKES ESTATES, TRACT 4152, BEING A SUBDIVISION OF A PORTION OF THE N1I2 OF THE SW1I4 OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MORAVE V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by Angelo Rinaldi, agent for Desert Lakes Development, Inc., and Sage Investment, Inc., Fort Mojave, Arizona. The project engineer of record is Stadler Consulting Engineers, Phoenix, Arizona, and WHEREAS, the property is located approximately three and one-half miles south of Bullhead City. The property is accessed via State Highway 95, then east one mile along Lipan Boulevard, then north several hundred feet along and east of Mountain View Road to the site, and WHEREAS, the Preliminary Plan depicts 80.46 acres subdivided into 272 single-family residential lots, and 14 drainage parcels. Residential lots range in size from 8,000 square feet to 9,260 square feet, and WHEREAS, the owner/developer has indicated in a letter dated October 21, 1997, that an Extension of Time is being requested due to an economic downturn that has weakened the prospect for sales of lots and homes in the subdivision, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on June 6, 1994, per BOS Resolution No. 94-170. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed. They have recommended that any required changes or modifications will be the responsibility of the developer, and WHEREAS, this action will constitute both the first and second Extensions of Time, and PAGE 2 OF 2 gK 3022 PG 8 FEE~S'8003375 RESOLUTION NO. 98-5 Page 2 WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request complies with the Extension of Time Policy due to the following: Though the developer's request for the Extension of Time of the Preliminary Plan is more than one year late, a phase of this subdivision has been recorded within the preceding two years, and WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution No. 94-170. 2. Unless significant progress is made in the coming year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until June 6, 1998. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED this Extension of Time as recommended by the Mohave County Zoning Commission and outlined herein.
