OFFICIAL RECORDS OF MOOAVE ;OUHTY, AZ 01/21198 01:55P PAGE 1 DF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 98-6 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 89-68, 89-69, 90-77, 90-112, 90-329, AND 90-355, WHICH CONDITIONALLY APPROVED PRELIMINARY PLANS, PETITIONS OF EXCEPTION, REZONING, A FINAL PLAT AND ZONING USE PERMIT FOR THE HIGHLANDS, TRACT 4091, BEING A SUBDIVISION OF A PORTION OF THE W1/2 OF SECTION 7, TOWNSHIP 18 NORTH, RANGE 21 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public heating was conducted to determine whether the approvals for the above-described project should be rescinded. The ownership of this property has recently changed, and is divided between separate developers including: Imperial Acres Investment Company LTD, Mohave Valley, Arizona; Roger A. and Mary A. Johnson, Fort Mohave, Arizona. The Mohave Valley Elementary School District #16, Mohave Valley, Arizona, is an owner of a portion of this property. The engineer of record is Burton Engineering, Inc., Bullhead City, Arizona, and WHEREAS, the property is located approximately five miles south of Bullhead City. The site is accessed via State Highway 95, then east two miles along Boundary Cone Road, and southeast to the property, and WHEREAS, the Preliminary Plan depicts 320 acres subdivided into 770 single-family residential lots, a commercial parcel and several drainage parcels. The subdivision had originally been processed with the name "The Hollingsworth, Tract 4091", and WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on October 2, 1989, per BOS Resolution No. 89-68. The property was rezoned on the same date per BOS Resolution No. 89-69. A revised Preliminary Plan was approved by the Board on April 2, 1990, per BOS Resolution No. 90-77. On May 7, 1990, BOS Resolution No. 90-112 approved the rezoning of a 2.1-acre commercial portion of the subdivision. The Final Plat for Phase A was approved on November 5, 1990, per BOS Resolution No. 90-329. A zoning use permit was approved on December 3, 1990, per BOS Resolution No. 90-355, allowing a mobile home as a sales office for the subdivision. The first Extension of Time for the conditional approval of the Preliminary Plan was approved by the Board of Supervisors on June 1, 1992, per BOS Resolution No. 92-181. The second extension was approved on May 3, 1993, per BOS Resolution No. 93-116. The third, fourth and fifth extensions were approved on March 7, 1996, per BOS Resolution No. 96-79, expiring April 2, 1997, and F'~GE 2 OF 2 BK 3022 PG ~LI) FEE~9800~396 RESOLUTION NO. 98-6 Page 2 WHEREAS, the subdivision has not been actively processed. No proposed phases of this subdivision have been recorded. Ownership in the property has split among separate developers who have not indicated an interest in further processing the old plan in conjunction with one another, nor under one tract in confomaance with the Preliminary Plan. Additionally, 15.46 acres of this property are now being processed as a school site, altering and rendering obsolete the design of the previously approved development. The lack of processing, the accrual of proposed changes to this subdivision and the lack of a current Extension of Time for the approvals of the Preliminary Plan warrant rescission of all approvals for the project, and WHEREAS, all resolutions, including BOS Resolution Nos. 92-181, 93-116 and 96-79, which require compliance with the conditions of the above referenced rescinded approvals, are themselves voided, and WHEREAS, all notices have been advertised and posted according to regulations, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
