HomeMy WebLinkAbout98-009 OFFICIAL RECORDS OF tlDHAVE COUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 01/21/98 01:55P PAGE 1 OF 2 MONAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0,00 RESOLUTION NO. 98-9 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 90-167 AND 90-168, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN, PETITION OF EXCEPTION AND REZONING FOR CASA DEL SOL, TRACT 4107, BEING A SUBDIVISION OF A PORTION OF THE NE1/4 OF THE NWl/4 OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The developer of this property is Joy Lane 40 Acre Limited Partnership, Scottsdale, Arizona. The engineer of record is Stovall Engineers, Inc., Bullhead City, Arizona, and WHEREAS, the property is located approximately three miles south o£ Bullhead City. The site is accessed via State Highway 95, then east one and one-quarter miles along and south of Joy Lane to the property, and WHEREAS, the Preliminary Plan depicts 40 acres subdivided into 127 single-family residential lots, a common open space parcel and a large drainage parcel (proposed Antelope Drain), and WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on July 2, 1990, per BOS Resolution No. 90-167. The property was rezoned on the same date per BOS Resolution No. 90-168. The first Extension o£Time for the conditional approval of the Preliminary Plan was approved by the Board of Supervisors on September 8, 1992, per BOS Resolution No. 92-288. The second extension was approved on August 2, 1993, per BOS Resolution No. 93-211. The third extension was approved on August 8, 1994, per BOS Resolution No. 94-255, expiring on July 2, 1995. No further extensions were requested by the developer, and WHEREAS, the subdivision has not been processed. No proposed phases o£this subdivision have been recorded. The developer has consented to the rescission of all approvals for this subdivision, and WHEREAS, all resolutions, including BOS Resolution Nos. 92-288, 93-211 and 94-255, which require compliance with the conditions of the above-referenced rescinded approvals, are themselves voided. All notices have been advertised and posted according to regulations, and WHEREAS, all notices have been advertised and posted according to regulations, and PAGE 2 OF 2 BK 3J~2 F'G 16 FEE~98003397 RESOLUTION NO. 98-9 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
