ECflRDER. rlOHAVE COUNTY BOARD OF SUPEE'.VIS~'S RESOLUTION NO. 98-10 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 91-64, 91-97, AND 91-285, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN, REZONING AND A SEPARATE PETITION OF EXCEPTION FOR PINE RIVER ESTATES, TRACT 4128, BEING A SUBDIVISION OF A PORTION OF THE NE1/4 OF THE SWl/4 OF SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The developer of this property is Bullhead 1, CSC, Long Beach, California. The engineer of record is Territorial Engineers, Inc., Bullhead City, Arizona, and WHEREAS, the property is located approximately two and three-quarter miles south of Bullhead City. The site is accessed via State Highway 95, then east one mile along Joy Lane, then north one-half mile along Mountain View Road, then east one-quarter mile along Hammer Lane, and southeast one-quarter mile over open desert to the property, and WHEREAS, the Preliminary Plan depicts 5 acres subdivided into 17 single-family residential lots, and WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on March 4, 1991, per BOS Resolution No. 91-64. The property was rezoned on April 1, 1991 per BOS Resolution No. 91-67. A separate Petition of Exception was approved on October 21, 1991, per BOS Resolution No. 91-285. The Final Plat for Phase A of this subdivision was approved on December 16, 1991, per BOS Resolution No. 91-338. The first and second Extensions of Time for the conditional approval of the Preliminary Plan were approved by the Board of Supervisors on October 4, 1994, per BOS Resolution No. 94-329, expiring on March 4, 1995. No further extensions were requested by the developer, and WHEREAS, the subdivision has not been processed. No proposed phases of this subdivision have been recorded, and WHEREAS, all resolutions, including BOS Resolution Nos. 91-338 and 94-329, which require compliance with the conditions of the above-referenced rescinded approvals, are themselves voided, and WHEREAS, all notices have been advertised and posted according to regulations, and F'~6E 2 OF 2 BI{ 3022 F'G 18 F'EE~98~-341') RESOLUTION NO. 98-10 Page 2 WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
