RESOLUTION NO. 98-14
A RESOLUTION SETTING FORTH A REZONE OF LOT 2, BLOCK 4, TIERRA PLAZA
REVISED, TRACT 4009-A, IN SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM
C-2/3A (GENERAL COMMERCIAL/THREE ACRE MINIMUM LOT SIZE) ZONE TO C-2/1A
(GENERAL COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE SOUTH
MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the
above-described property as requested by Hampton Development being represented by John L. McCormick,
III, the managing partner/owner, Bullhead City, Arizona, and
WHEREAS, this property is located east of State Highway 95 between Camp Mohave Road and
Sterling Road. The site is accessed from State Highway 95 via east on Valencia Road to the site, located
on the north side approximately 200 feet east of State Highway 95. The property is vacant and relatively
flat, sloping slightly to the west toward the Colorado River. The surrotmding land uses consist of vacant
lots and numerous small businesses to the north and east. There are single-family residences to the south and
vacant land to the west across State Highway 95. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for marketing the property to multiple
commercial buyers. The applicant proposes to divide the 3.85-acre parcel into three equai-sized lots. The
Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2435D indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, a condition of Resolution P&ZC No. 85-148, which approved the present C-2/3A
zoning, stated that "The establishment of a minimum lot area requirement to prevent the lots as designed
to be further split or divided." The purpose of this condition was to keep lots from being further split and
to limit the commercial traffic on Kathy South. However, those concerns no longer apply to this lot.
Typical commercial lots in this subdivision range from 0.91 acre to 13,000 square feet. This lot is three-
plus acres in size. The proposed division is consistent with other lot sizes in the area. The lots north of
Kathy South are zoned C-2, the same zone as the subject parcel. Since Kathy South supports commercial
traffic, access to this street from the subject lot should not be a problem, and
WItEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains land uses similar to the above-proposed action.
e. The site has legal access.
fi There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 10, 1997, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned C-2/1A (General Commercial/One Acre Minimum Lot Size).
This approval is for this lot only and supersedes conditions 1, 2, and 3 of Resolution P&ZC
No. 85-148.
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Upon development, Section 27.P (Site Plan Requirements) must be completed
and approved prior to approval of permits and before establishing the use. This supersedes
condition 2 of Resolution P&ZC No. 85-148.
4. All fights-of-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
5. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
6. Each parcel shall have legal access.
7. The applicable flood zone(s) shall be noted on the Parcel Plat.
8. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to any development or construction. These permits will not be issued until Parcel Plat
recordation.
9. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.

10. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and I02.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supervisors approval, this rezone approval will be void.
All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and applicant who requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, January 5, 1998, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
