HomeMy WebLinkAbout98-015 INDEXED OFF~C[~L RECOROS OF HOH~VE C:OUNTY~ AZ JOAN MC CALL~ MOHAVE COUNTY RECORDER MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0,00 RESOLUTION NO. 98-15 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 22, EXCEPT THE NORTH 277 FEET, BLOCK B, FORT MOHAVE MESA RANCHOS, IN SECTION 26, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A LANDSCAPING BUSINESS IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAYE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Donald L. Leininger of Fort Mohave, Arizona, and VOtEREAS, this property is located east of State Highway 95 and between E1 Rodeo Road and Joy Lane. The site is accessed fi.om State Highway 95 via east on Wagon Wheel Lane to Jack Rabbit Drive, then south on Jack Rabbit Road to the site, located on the west side approximately 300 feet south of Wagon Wheel Lane. The property has a single-family residence, a garage, shed, and an office on it and is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of vacant lots and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a landscaping business in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel//040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: PAGE~° OF' ~ RESOLUTION NO. 98-15 Page 2 I. This Zoning Use Permit is for a landscaping business in an A-R (Agricultural-Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not conrmenced within one year of Board approval of the Zoning Use Pemfit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
