MOHAVE COUNTY BOARD OF SOPERVISO~¢ RECORDING FEE %00 RESOLUTION NO. 98-16 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL "A," WILLOW VALLEY MOBILE HOME ESTATES, UNIT 17, TRACT 1072, IN SECTION 27, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A 100,000-GALLON WATER STORAGE TANK AND BOOSTER STATION 1N AN R-1 (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Willow Valley Water Company of Mohave Valley, Arizona, and WHEREAS, this property is located west of State Highway 95, south of King Street. The site is accessed from State Highway 95 via west on King Street to Smoketree Lane, then south on Smoketree Lane to the site, located on the west side of Smoketree Lane between Green Valley Way North and Green Valley Way South. The property is a well site along with a pressure tank. The surrounding land uses consist of single-family residences and vacant lots. There is Fort Mojave Indian Reservation land to the west. There are no significant drainage patterns, and WItEREAS, the applicant requests this Zoning Use Permit for a 100,000-gallon water storage tank and booster station in a R-1 (Single Family Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2605C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: P~6E o OF s, B~'; ~022 F'6 911 FEE¢9800~774 RESOLUTION NO. 98-16 Page 2 1. This Zoning Use Permit is for a 100,000-gallon water storage tank and booster station in a R-1 (Single Family Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Pem~it or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
