WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Todd R. and Joan M. Shumway of Bullhead City, Arizona, and WHEREAS, this property is located east of State Highway 95 between Jerome Avenue and Hulet Avenue. The site is accessed from State Highway 95 via east on Jerome Avenue to Calle del Media, then south on Calle del Media approximately one-quarter mile to an unnamed road, then east on this unnamed road approximately 400 feet to the property, located on the south side of the road. The property has a single- family residence and an equestrian arena on it. The property is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of vacant lots and a few scattered single- family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an equestrim~ activity arena in an A-R (Agricultural-Residential zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2605C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 98-17 Page 2 WHEREAS, at the public hearing before the Mohave County Plarming and Zoning Commission on December 10, 1997, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. The proposed use is in conflict with the surrounding neighborhood and area. 2. The surrounding property owners object to the large crowds and traffic on the roads. 3. The surrounding property owners object to a commercial type use in a residential at-ea. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and WHEREAS, at their meeting on February 2, 1998, the Board of Supervisors held a public hearing and considered comments from the public. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 2, 1998, APPROVED this Zoning Use Permit subject to the following conditions: 1. This Zoning Use Permit is for an equestrian activity arena in an A-R (Agricultural- Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations including, but not limited to, Ordinance 87-1, "Dark Sky Ordinance". Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of pemfits or establishing use. 3. That the 20-foot radius curve at the northeast comer roadway right-of-way shall be dedicated to the public and accepted by the Mohave County Board of Supervisors. 4. The eight feet adjoining all rights-of-way shall be granted to the public as a Public Utility Easement (PUE). 5. The decibel level at the property boundary shall not exceed 65 db. 6. Events shall not be held outside the hours of 6 a.m. through 10 p.m. Sunday through Thursday and 6 a.m. through midnight Friday and Saturday. 7. Sanitary facilities and procedures for people and animals shall be approved by Mohave County Environmental Health. BK 30:]$ PG 200 FEE$9800853' RESOLUTION NO. 98-17 Page 3 8. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 9. Driveways and roadways to be used as access to the arena shall be stabilized in a manner approved by the County Engineer from the intersection of Calle del Media and Jerome to the arena. 10. The parking lot shall be covered with a dust-free and durable surface. Crashed rock or asphalt milling is acceptable surfacing. 11. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 12. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare.
