WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 2, 1998, a public heating was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Bruce A. Mitchell, P.E., Right-of-Way Supervisor, Citizens Utilities Company, Electric Division, Kingman, Arizona, and WHEREAS, this property is located west of Interstate 40 and south of Yucca Drive, between Yuma Road and Cente~mial Road. The site is accessed from Interstate 40 via the Griffith Road Interchange, then west on Griffith Road to Apache Road, then north on Apache Road to Yucca Drive, then west on Yucca Drive to the site, located on the south side between Yuma Road and Centennial Road. The property is vacant and relatively flat, sloping slightly to the southwest. Them are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WItEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on December 4, 1995 via BOS Resolution No. 95-496, and WHEREAS, this Extension of Time will allow the applicant to accomplish the conditions as required by BOS Resolution No. 95-496. The applicant has sold a portion of the property to Arizona Public Service (APS) and APS will build the generation site, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 95-496. Arizona Public Service (APS) anticipates a start construction date in the first quarter of 2000, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2600B indicates the parcel described to be in Zone A, in the.Special Flood Hazard Area, and F'~GE 2 OF 2 BK i]4129 PG 217 FEEt:98006214 RESOLUTION NO. 98-24 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 95-496. 2. This Extension of Time will be in effect until December 4, 2000. 3. The zoning for the Citizens Utilities Company (CUC) parcel and the Arizona Public Service (APS) parcel will have to be vested separately. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 2, 1998, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
