""- RESOLUTION NO. 98-33 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 2, LAKE MOHAVE RANCHOS, UNIT 8, FIRST AMENDED, IN SECTION 19, TOWNSHIP 26 NORTH, RANGE 18 WEST, FOR A DOG KENNEL IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Edwin L. and Mary K. Steward of Dolan Springs, Arizona, and WHEREAS, this property is located east of Pierce Ferry Road between Fifteenth Street and Seventeenth Street. The site is accessed from Pierce Ferry Road via east on Seventeenth Street to the site, located on the south side between Mead Drive and Merry Drive. The property has a single-family residence along with a garage and dog kennel buildings on it. The surrounding land uses consist of vacant land and a few scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a dog kennel in an A-R (Agricultural- Residential) zone for breeding "toy-breed" dogs only. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 10, 1997, the Comntission recommended APPROVAL for a Zoning Use Permit subject to the following: F'~GE 2 OF 2 RESOLUTION NO. 98-33 Page 2 1. This Zoning Use Permit is for a dog kennel in an A-R (Agricultural-Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not cmnmenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 5, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~ MOHAVE COUNTY BOARD OF SUPERVISORS _ [-~r' Carol S.
