RESOLUTION NO. 98-36
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 17 AND 18, SUNHAVEN
HOMESITES, IN SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A RESIDENCE
IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Joseph N. and Donna R. Garrison of Tempe, Arizona, and
WHEREAS, this property is located northwest of State Highway 66, northeast of the City of
Kingman. The site is accessed from State Highway 66 via northwest on Diagonal Way to Able Drive, then
northeast on Able Drive to the site, located on the southeast side approximately 1,000 feet northeast of
Diagonal Way. The property is vacant and relatively flat, sloping slightly to the southeast. The surrounding
land uses consist of several general commercial businesses to the east along State Highway 66 and single-
family residences and vacant lots to the north, west, and south. There are no significant drainage patterns,
and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2 (General
Commercial) zone. The Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action imended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 10, 1997, the Commission reconm~ended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Pemait is for a residence in a C-2 (General Commercial) zone.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not cormnenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted on December 19, 1997,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, January 5, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
