RESOLUTION NO. 98-46
A RESOLUTION SETTING FORTH A REZONE OF THE N% S% SE¼ SE¼ SE¼ OF SECTION
21, TOWNSHIP 39 NORTH, RANGE 16 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL)
ZONE TO C-MO (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE
ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
2, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the
above-described property as requested by Bruce Briscoe of Bunkerville, Nevada, and
WHEREAS, this property is located south of Elbow Canyon Road and east of the Arizona/Nevada
state line. The site is accessed from Mesquite, Nevada via east on Elbow Canyon Road to Littlefield Drive,
then south approximately one mile on Littlefield Drive to the site, located on the west side. The property
has a single-family residence and several accessory buildings on it. The terrain is relatively flat, sloping
slightly to the north toward the Virgin River. The surrounding land uses consist of vacant BLM land to the
east and south, and vacant lots, along with a few single-family residences, to the north and west. There are
no significant drainage pa~tems, and
WHEREAS, the applicant requests this zone change to allow for a junk yard. The applicant
proposes to rezone the north one-half of the property to C-MO (Commercial-Manufacturing/Open Lot
Storage). The Mohave County General Plan designates this area as a Rural Developmem Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this rezone action is to correct a violation of the Mohave County Zoning Regulations,

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect DOES NOT comply with the Mohave County General
Plan and the proposed Virgin River Communities Area Plan.
c. The site is not adequate for the action intended and the use is inconsistent with the
surrounding land uses and terrain.
d. The site has legal access.
e. There are no significant enviromnental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Plamfing and Zoning Commission on
January 14, 1998, the Commission recommended DENIAL for a Rezone based upon the following:
1. This rezone request constitutes spot zoning as this is a residential area.
2. The access to this property is limited.
3. This rezone request does not comply with the proposed Virgin River Communities Area Plan
as this area is designated a Low Density Residential Ama (up to 5 dwelling units per acre).
4. In addition, refuse on this lot is not contained and is blowing on to neighboring properties.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 2, 1998, DENIED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
