A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 97-259
SETTING FORTH A REZONE OF THE S~ NE¼ NE¼ NE~A OF SECTION 21, TOWNSHIP 14
NORTH, RANGE 20 WEST, FROM C-M (COMMERCIAL-MANUFACTURING) ZONE TO M
(GENERAL MANUFACTURING) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
2, 1998, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 97-
259, setting forth a Rezone, should be granted for the above-described property as requested by J. A. "Pete"
Schrage representing Commercial Water Sports and Hoss Custom Trailers, Inc., of Lake Havasu City,
Arizona, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been
and
WHEREAS, this property is located east of State Highway 95 and south of Chenoweth Drive. The
site is accessed from State Highway 95 via east on Chenoweth Drive approximately 700 feet to an Ingress
and Egress (I&E) easement, then south approximately 325 feet on this I&E to the site. The property is
vacant and relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses
consist of vacant land and several general commercial businesses. There are no significant drainage patterns,
and
WHEREAS, the applicants request this Amendment to BOS Resolution No. 97-259, approving
a Rezone, to delete Condition of Approval Number 2, that requires a view-obscuring fence around this
property. The reason for this request is the topography of the property. The Hoss Custom Trailers,
Inc., facility is located on a building pad where the elevation is below the properties to the north. The
Commercial Water Sports facility is located on a building pad below Hoss Custom Trailers, Inc., and
the properties to the north. During the site survey it was noted that there is a requirement for a fence
along the west side of this property and along the south side of the Commercial Water Sports facility.
The I-Ioss Custom Trailers, Inc., facility is located above the existing fence. The zoning on the
property to the west is R-E (Residential-Recreation) and on the south is zoned C-M/10A (Commercial-
Manufacturing/Ten Acre Minimum Lot Size), and
WHEREAS, the Mohave County General Plan designates this area as an Urban Development Area,
and

WHEREAS, a review of FEMA FIRM Panel #040058-311 OB indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this item was first heard at the December 10, 1997, Planning and Zo~fing Commission
meeting. It was continued by the applicant to allow for an on-site inspection and further evaluation, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent ~vith the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 14, 1998, the Commission reconunended APPROVAL for an Amendment to BOS Resolution No.
97-259 setting forth a Rezone of the S½ NE¼ NE~¼ NE¼ of Section 21, Township 14 North, Range 20
West, subject to the following:
1. This property will be rezoned M (General Manufacturing).
2. The applicant will provide a view-obscuring fence ar6und along the south side of the
Commercial Water Sports facility in the area between the two earth berms, thi~
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
6. If these conditions are not met within two years this approval will be void. If at the
expiration of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 2, 1998, APPROVED this Amendment to BOS Resolution No. 97-259 setting £orth
a Rezone of the S½ NE¼ NE¼ NE¼ of Section 21, Township 14 North, Range 20 West as reconunended
by the Mohave County Planning and Zoning Commission and outlined herein.
