A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ASSURANCES FOR
THE COMPLETION OF IMPROVEMENTS FOR DESERT LAKES GOLF COURSE AND
ESTATES, TRACT 4076-C, BEING A SUBDIVISION OF A PORTION OF SECTION 36,
TOWNSHIP 19 NORTH, RANGE 22 WEST; AND FOR LOS LAGOS, TRACT 4096-A, BEING A
SUBDIVISION OF A PORTION OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST;
AND FOR DESERT LAKES ESTATES, TRACT 4152-A, BEING A SUBDIVISION OF A PORTION
OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, ALL IN THE SOUTH MOHAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
2, 1998, a public hearing was conducted to determine whether an Extension of Time should be granted for
the assurances for the completion of all improvements in the above-referenced subdivisions, and
WHEREAS, the developer of these subdivisions is Desert Lakes Development/Los Lagos
Development, Fort Mohave, Arizona. Ihe project engineer of record is Stadler Consulting Engineers, Inc.,
Phoenix, Arizona, and
WHEREAS, the Final Plat of Desert Lakes Golf Course and Estates, Tract 4076-C, was recorded
on May 23, 1990. The Final Plat of Los Lagos, Tract 4096-A, was recorded on August 27, 1991. The Final
Plat of Desert Lakes Estates, Tract 4152-A, was recorded on November 28, 1995. The assurances for all
three of the subdivisions are covered under the same agreement and financial account. Article 5.4 of the
Mohave County Subdivision Regulations states: "The duration of the performance bond or other assurance
shall be for one (1) year from the date of recording. Extensions of Time in one (1) year increments may be
granted by the Board of Supervisors by showing just cause.", and
WHEREAS, the developers have submitted As-Built Improvement Plans for some improvements
already completed in Los Lagos, Tract 4096-A, and in Desert Lakes Estates, Tract 4152-A. As-built
improvement plans have just recently been submitted for review, for the completion of improvements in
Desert Lakes Golf Course and Estates, Tract 4076-C. Upon completion of the review of the as-built plans
for Tract 4076-C, and upon the recommendation of approval of the as-bullts from the County Engineer, the
acceptance of the as-built plans and the requested release of the remaining assurances for the completion of
improvements in Tract 4076-C will be scheduled for consideration of the Planning and Zoning Commission
at a future Commission meeting, and

WHEREAS, the outstanding assurance balances as of the latest partial release dated December 4,
1996, is: Los Lagos, Tract 4096-A, $744,756.18; Desert Lakes Estates, Tract 4152-A, $185,982.20; and
Desert Lakes Golf Course and Estates, Tract 4076-C, $54,132.00. The developers appear to be malting some
progress toward the completion of improvements required of each of these subdivisions, and
WHEREAS, the Public Works Department has commented that the project engineer must submit
a progress report including the amount of improvements completed in each respective subdivision, the
amount of improvements remaining in each, and an expected date of completion of the improvements, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 14, 1998, the Commission recommended APPROVAL of an Extension of Time of the assurances
for the completion of improvements for these subdivisions, subject to the following conditions:
1. The developers must, within 90 days of the date of Board approval of this extension, submit
to the Plmming and Zoning Department a progress report prepared by the project engineer,
including a description of the amount of improvements completed in each subdivision, the
amount of improvements remaining, and an expected date of completion of the
improvements.
2. This Extension of Time will be in effect until December 20, 1998.
WHEREAS, the advertising requirements have been met throughout this subdivision process as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 2, 1998, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
