RESOLUTION NO. 98-52
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF MESA VISTA, TRACT 4117, BEING A SUBDIVISION
OF A PORTION OF THE SW1/4 OF SECTION 24, TOWNSHIP 19 NORTH, RANGE 22 WEST,
IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
2, 1998, a public heating was conducted to determine whether approval should be granted for an Extension
of Time as requested by the developer, Rossberg Family Trust. The project engineer of record is Tri-State
Land Surveyors and Civil Engineers, La Quinta, California, and
WHEREAS, the subdivision is located approximately two miles south of Bullhead City. The
property is accessed via State Highway 95, then east one mile along and north of E1 Rodeo Road to the site,
and
WHEREAS, the Preliminary Plan depicts 42 acres subdivided into 147 single-family residential lots
and one 4-acre commercial parcel, and
WHEREAS, the agent for the owner/developer has indicated in a letter dated November 26, 1997,
that an Extension of Time is being requested due to continued work toward a resolution of the conceins of
FEMA, and a possible need for a redesign of the flood-prone portions of the development, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on December 3, 1990, per BOS Resolution No. 90-349. The Final Plat was approved on April
1, 1991, per BOS Resolution No. 91-110. The first and second Extensions of Time for the Preliminary Plan
were approved on February 1, 1994, per BOS Resolution No. 94-39. The third extension was approved on
January 3, 1995, per BOS Resolution No. 95-3. The fourth extension was approved on March 7, 1996, per
BOS Resolution No. 96-78. A fifth extension was approved on February 3, 1997, per BOS Resolution No.
97-32. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the
expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of
Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all
proceedings relating to the plat shall be terminated.", and
WHEREAS, regarding the submittal of a revised Preliminary Plan of the subdivision, the Public
Works Deparmaent stated that until a determination could be received from FEMA as to the likelihood of
flooding in the southern portion of the subdivision, and as to access to the E1 Rodeo Drainage Channel, the

review could not be completed. The revised Preliminary Plan has not been considered by the Plmming and
Zoning Commission and the Board of Supervisors, as outstanding review comments have yet to be
addressed. From recent staff meetings with the developer and the project engineer, a redesign of the
subdivision may be forthcoming to accommodate a revised phasing scheme which would process the non-
flood-prone portion of the property as a first phase, while waiting for FEMA to clear the remainder of the
subdivision for future development, and
WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed. They have recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this will be the sixth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request may comply with the Extension of Time Policy based on the following: Though
a Final Plat has not been actively processed for this subdivision, the owner and project
engineer have expressed a continued interest in working through Mohave County Public
Works to attempt to clear this property with FEMA to allow for development.
c. One of the conditions of the previous Extension of Time stipulated that, "Unless significant
progress is made in the coming year toward the recordation of this project, Planning staffwill
recommend denial of any additional Extensions of Time for this Preliminary Plan". The
reviewing County departments, having negotiated with the Federal Emergency Management
Agency on behalf of the developers of this subdivision, consider those efforts to be
acceptable as "significant progress" to recommend a further extension of the Preliminary
Plan for the project, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 14, 1998, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution Nos. 90-349, 91-110, 94-39, 95-3, 96-78,
and 97-32.
2. If revised plats of this subdivision are submitted including substantial changes from the
Preliminary Plan being extended herein, the extent of the changes may require the developer
to process a new Preliminary Plan or a new Sketch Plan.
3. Unless significant progress is made in the coming year toward the recordation of this project,
Planning staff will recommend denial of may additional Extensions of Time for this
Preliminary Plan.

4. This Extension of Time will be in effect until December 3, 1998.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 2, 1998, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
