HomeMy WebLinkAbout98-055I'~<~ INDEXED ~ RECORO(N~ FEE IJ,I)l) ~', 5'4: y RESOLUTION NO. 98-55 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF LOT 113, BERMUDA PLANTATIONS, UNIT 2, IN SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, FROM R-E (RESIDENTIAL-RECREATION) ZONE TO C-2/25M (GENERAL COMMERCIAL/TWENTY-FIVE THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 2, 1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Maged M. Hannawi ofLoma Linda, Califomia, and WHEREAS, this property is located southeast of Harbor Avenue between Courtwright Road and the Needles Bridge. The site is accessed from State Highway 95 via south on Harbor Avenue to the site, located on the south side of Harbor Avenue and Vacation Avenue. The property is vacant and relatively flat. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on December 2, 1996 via BOS Resolution No. 96-407, and WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as required by BOS Resolution No. 96-407. The applicant has experienced a delay in the engineering area; however, his general contractor believes that problem should be cleared up by the end of November 1997. An Extension of Time has been requested to allow ample time to resolve this issue, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2615C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. RESOLUTION NO. 98-55 Page 2 d. The neighboring area contains land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 14, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 96-407. 2. This Extension of Time will be in effect until December 2, 1998. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 2, 1998, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
