OF 2 Z~ RE(:ORP!N6 FEE 0.00 RESOLUTION NO. 98-62 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE E¼ OF LOT 5, BLOCK F, GOLDEN SAGE RANCHOS, UNIT 58, IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 18 WEST, FOR A SMALL PLANT NURSERY IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Patrick D. and Eulene B. Bowman of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68 between Colorado Road and Teddy Roosevelt Road. The site is accessed from State Highway 68 via north on Teddy Roosevelt Road to Supai Drive, then east on Supai Drive to the site, located approximately 155 feet east of La Osa Road. The property has a single-family residence with a garage and several accessory buildings. The property is relatively flat, sloping slightly to the south. The surrounding land uses consist of vacant lots and single- family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a small plant nursery in an A-R (Agricultural-Residential) zone as allowed in Section 14.C-4, Regulations for Agricultural-Residential Zone, of the Mohave County Zoning Regulations. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning mad Zoning Commission on January 14, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-62 Page 2 1. This Zoning Use Permit is for a small plant nursery in an A-R (Agricultural-Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall temfinate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 2, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
