RESOLUTION NO. 98-63 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 15, BLOCK N, GOLDEN SAGE RANCHOS, UNIT 55, IN SECTION 11, TOWNSHIP 21 NORTH, RANGE 18 WEST, FOR A RESIDENCE IN A C-2H/1A (GENERAL COMMERCIAL HIGHWAY FRONTAGE/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Ronald and Panla Kay Apt of Golden Valley, Arizona, and WHEREAS, this property is located on the north side of State Highway 68, between Bacobi Road and Aztec Road. The site is accessed directly from State Highway 68 and is located approximately 155 feet east of Horn Road. The property has two commercial buildings and a mobile home sales lot on it and is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of other highway commercial businesses, vacant lots, and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2H/1A (General Commercial Highway Frontage/One Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Plmming and Zoning Commission on January 14, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-63 Page 2 1. This Zoning Use Permit is for a residence in a C-2H/1A (General Commercial Highway Frontage/One Acre Minimum Lot Size) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use, if there is not a current site plan on file with the Mohave County Planning and Zoning Department. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not conunenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 2, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Conmfission and outlined herein.
