RESOLUTION NO. 98-64
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THAT PORTION OF
PARCEL 266 LYING SOUTHERLY OF STATE HIGHVqAY 68, EXCLUDING THE NORTHERLY
300 FEET PARALLEL WITH STATE HIGHWAY 68, IN SECTION 10, TOWNSHIP 21 NORTH,
RANGE 19 WEST, FOR A RECREATIONAL VEHICLE PARK IN AN A-R/10A
(AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN
VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-desaribed property as requested by Sun Capitol, Inc., o£ Kingman, Arizona, and
WHEREAS, this property is located south of State Highway 68 between Emery Park Road and
Escuela Road. The site is accessed from State Highway 68 via south on either Emery Park Road or Escuela
Road to the site, located approximately 300 feet south of State Highway 68. The property is vacant and
relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant land and a
realty office to the north and several single-family residences. There are no significant drainage patterns,
and
WHEREAS, the applicant requests this Zoning Use Permit for a recreational vehicle park in an A-R/
10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone. The Mohave County General Plan
designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area. Note: There are portions of this parcel in Flood Zone C, not
in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant enviromnental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 14, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a recreational vehicle park in an A-R/10A (Agricultural-
Residential/Ten Acre Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mehave County Zoning
Regulations. Section 27.J (Recreational Vehicle Park Plan Requirements) must be
completed and approved prior to approval of permits and before establishing the use.
4. That 30 feet of the existing 50-foot roadway easement laaown as Esquela Road and Emery
Park Road, and that 35 feet of the existing 50-foot roadway easement known as Mahone
Drive shall be dedicated to the public and accepted by the Mohave County Board of
Supervisors as road right-of-way. In addition, 20-foot radius curves are required at all
dedicated roadway intersection points. This may be accomplished via separate instrument.
5. The remaining 20 feet of the existing 50-foot roadway easement known as Esquela Road and
Emery Park Road, and the remaining 15 feet of the existing 50-foot roadway easement
known as Mahone Drive must be abandoned before any part can be granted to the public as
a Public Utility Easement (PUE) and drainage easement.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 2, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
