RESOLUTION NO. 98-67
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 100-FOOT ROADWAY
EASEMENT KNOWN AS ESCUELA ROAD WITHIN THAT PORTION OF PARCELS 265 AND
266 LYING SOUTHERLY OF HIGHWAY 68, IN THE NE¼ OF SECTION 10, TOWNSHIP 21
NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
2, 1998, a public hearing was conducted to determine whether approval should be granted to abandon the
above-described roadway easement as requested by the owner, Sun Capital, Inc., an Alaskan Corporation,
represented by Max Bevins of Kingman, Arizona, and
WHEREAS, this property is located south of Slate Highway 68 between Estrella Road and Emery
Park Road. The site can be accessed directly from State Highway 68 and extends to the intersection of
Mahone Drive, a distance of approximately 1,400 feet. The easement has not been improved and the
alignment is not readily apparent from field observation. The terrain is relatively flat and slopes slightly
toward the southeast. The surrounding land uses consist of vacant parcels and a few widely scattered single-
family residences and a business along Highway 68. The southern part of the roadway easement is within
a wash a few feet wide, and
WHEREAS, the owner plans to construct an RV park containing approximately 80 spaces on the
property. Abandoning the roadway easement will allow for the further utilization of site because the 25-foot
setback, required by Section 27.J.4.c.2.a, Mohave County Zoning Ordinance, between a minor road and an
RV space, would no longer apply, and
WHEREAS, Lance H. Blakesley of Santa Monica, California, owns adjoining Parcel 265 and has
provided written concurrence to the abandonment of the roadway easement, and
WHEREAS, the Mohave County Public Works Department recommends denial of this
abandonment based upon the fact that the roadway does not lie entirely within the boundaries of this
development, and the Department cannot determine that there will not be a future need or benefit derived
from the road easement, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the
Sacramento Valley/Golden Valley Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. The site has a wash crossing the southern part at Mahone Drive.
f. There are no significant enviromnental features affecting the site, except the Special Flood
Hazard area noted above.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 14, 1998, the Commission recommended APPROVAL for the Abandonment subject to the
following:
1. The conditions of any Board of Supervisor Resolution concerning the approval of a
Recreational Vehicle Park or other use on this property will be met prior to the abandonment
of the Roadway Easement.
2. A 20-foot public utility easement shall remain between lots 265 and 266.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 17, 1998, and January 24, 1998, and posted
January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 2, 1998, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
