HomeMy WebLinkAbout98-071 RESOLUTION NO. 98-71 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE N~ AND THE N¼ S~ OF LOT 33, ORO ACRES, AMENDED, A SUBDIVISION OF SUNWARD HO! RANCHES, IN SECTION 6, TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A DOG KENNEL IN AN A-R/4A (AGRICULTURAL-RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Larry and Juanita Tabor of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road between Calle Alamo m~d Calle Castano. The site is accessed from Stockton Hill Road via east on Cactus Wren Road to Cherum Road, then north on Chemm Road to Calle Castano, then east on Calle Castano to Avenida Ramirez, then north on Avenida Ramirez to the site, located on the southwest comer of Avenida Ramirez and Calle Alamo. The property has a single-family residence on it, along with several dog kennels, and there are several horses being kept. The terrain is relatively flat, sloping slightly to the southeast. The surrounding land uses consist ora few scattered single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a dog kennel in an A-R/4A (Agricultural-Residential/Four Acre Minimum Lot Size) zone for keeping existing family dogs. Mohave County Zoning Regulations, Section 27.M, requires a Zoning Use Permit when five or more dogs are being kept. The Mohave County General Plan designates this area as a Suburban Development Area but the Long Mountain Area Plan designates this area as RR/5A (Rural-Residential/Five Acre Minimum Lot Size), and WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this item was heard by the Board of Supervisors at their meeting on December 1, 1997, and was referred back to the Planning and Zoning Commission for further review. This was done at the request of Mr. Sondgeroth, Chairman of the Planning and Zoning Commission, because there ~vas additional information that the Commission did not have available when they first considered this item. This information included a petition and photographs submitted by the applicant, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. RESOLUTION NO. 98-71 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 14, 1998, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. The proposed kennel does not fit into the residential nature of the neighborhood. 2. The opposition from the surrounding property owners. 3. The general condition of the area around the mobile home and where the dogs are being kept. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 17, 1998, and posted on January 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 2, 1998, DENIED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
