HomeMy WebLinkAbout98-371 9806Cm628 BK 3173 F'6 ¢38 OFFICIAL RECORDS OF MOHAVE COUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 10/07/1998 02:47P PAGE 1 OF 3 MOHAUE COUNTY BOARD OF SUPERVISORS RECORDING FEE O.OD RESOLUTION NO. 98-371 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE W¼ NE¼ OF SECTION 28, TOWNSHIP 21 NORTH, RANGE 16 WEST, FOR A RIDING STABLE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Lee E. and Gall M. Bruno and Alfred Jay and Tormna Schritter of Kingman, Arizona, and WHEREAS, this property is located east of the City of Kingman, between Cheyenne Avenue and Hualapai Mountain Road. The site is accessed from Hualapai Mountain Road via northeast on Seneca Street to Cheyenne Avenue, then east on Cheyenne Avenue to the site, located on the south side between Delaware Drive and Pawnee Road. The property is vacant and the terrain is gently rolling hills, generally sloping to the west. The surrounding land uses consist of vacant land with several pipelines, a 230-KV transmission line, and several large-lot, one-acre or greater, subdivisions to the north and west. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a riding stable in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning aJ~d Zoning Commission on September 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: gK 317~ Pg ~9 FEE$9~06062i~ RESOLUTION NO. 98-371 Page 2 1. This Zoning Use Permit is for a riding stable on the property, as shown on Exhibit "A", in an A-R (Agricultural-Residential) zone and activities related thereto. 2. The applicant shall comply with ali applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) nmst be completed and approved prior to approval of permits and before establishing the use. 3. Concurrence will be required from Transwestern Pipeline Company regarding the method of crossing the pipeline easement. 4. The applicant will have to request water service from Municipal Utility Commission (MUC) and receive approval from the Kingman Common Council as this is an undivided parcel within the Kingman Water Service Area. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 6. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Zoning Use Permit as reconunended by the Mohave County Plannin and Zoning Commission and outlined herein.
