RESOLUTION NO. 98-395
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE E~ NE¼, NE¼ SE¼ AND
PORTIONS OF SW¼ NE¼ AND NW¼ SE¼ OF SECTION 4, TOWNSHIP 39 NORTH, RANGE 16
WEST, FOR RODEOS, CIRCUSES, ARCADES, CAR SHOWS, AND OTHER RECREATIONAL
EVENTS OPEN TO THE PUBLIC IN A C-RE (COMMERCIAL-RECREATION) ZONE, IN THE
ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Arvada Ranch Properties, LLC, of Mesquite, Nevada, being
represented by Stephen M. Lee, Attorney-at-Law, of Kingman, Arizona, and
WHEREAS, this property is located south of Interstate 15 and east of Mesquite, Nevada. The site
is accessed from Interstate 15 via south and then east on Peppermill Palms Boulevard approximately one
and three-eighths miles to the northwest corner of the property. The property has several buildings,
including a rodeo arena and a pavilion, on it. The terrain is gently rolling hills, generally sloping to the
south toward the Virgin River. The surrounding land uses consist of vacant range land and a few scattered
single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for rodeos, cimuses, arcades, car shows,
and other recreational events open to the public. The Mohave County General Plan designates this area as
an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring ama contains recreational land uses similar to the above-proposed action,
but they do not have large assemblages of people and automobiles.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 14, 1998, the Conmtission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for rodeos, circuses, arcades, car shows, and other recreational
events open to the public and activities related thereto on the property as shown on Exhibit
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. For each special event where the nun~ber of participants and spectators is expected to exceed
500 people, the applicant shall submit for approval by Mohave County a Traffic and Safety
Management Plan at least 90 days prior to the event providing the following information:
a. Estimated number of participants and spectators.
b. A detailed Traffic Management Plan covering access road to the site and internal
circulation.
c. Emergency medical provisions.
d. Restrooms, solid waste disposal and other Environmental Health requirements that
are beyond those provided by the permanent facilities.
e. Proposed on-site security.
f. Methods for reimbursing Mohave County for traffic management and law
enforcement costs incurred that are above the nom~al provided for the area.
g. Method for dust control.
h. Any work on a public road or roads shall require a permit issued by Mohave County
Public Works Department with the appropriate bonds and insurances provided.
4. The Mohave County Department of Health & Social Services, Environmental Health
Division, requires that all food services, whether temporary or permanent, must be permitted
through the Environmental Health office. To obtain a permit, current Arizona State Codes
must be met, including hand washing facilities, food protection from contamination, and
temperature regulation. A complete copy of the Arizona requirements may be obtained from
the Environmental Health office.
5. The event organizer will ensure that all vendors will have all the required permits including,
but not limited to, Environmental Health Department and Sheriff's Office.
6. The applicant shall meet all the Swap Meet Guidelines for vendors.

7. The applicant shall provide sanitary restrooms according to the Unifom~ Plumbing Code and
any other applicable codes under the Mohave County Building Codes. The number of units
required is dependent upon the proposed number of people to be served. Permanent facilities
will be required if permanent food service is proposed. "Port-a-Potties" may be used for
recurring special events.
8. The applicant shall provide garbage containers that must be accessible and sufficient in
number to handle the demand. ALL containers must be covered.
9. The applicant shall replace and repair the damaged and torn down fence along the east
boundary of this property
10. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
11. If conslxuction or use has not commenced within one year of Board approval of the Zoning
Use Pemfit or if the use has been discontinued for six months, then approval shall terminate
at that date.
12. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 17, 1998, and posted on October 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 2, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
