RESOLUTION NO. 98-400
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ASSURANCES FOR
THE COMPLETION OF IMPROVEMENTS FOR LOS LAGOS, TRACT 4096-A, BEING A
SUBDIVISION OF A PORTION OF SECTION l, TOWNSHIP 18 NORTH, RANGE 22 WEST;
AND FOR DESERT LAKES ESTATES, TRACT 4152-A, BEING A SUBDMSION OF A PORTION
OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
2, 1998, a public hearing was conducted to determine whether an Extension of Time should be granted for
the assurances for the completion of all improvements for the above-referenced subdivisions. The developer
of these subdivisions is Desert Lakes Development/Los Lagos Development, Fort Mojave, Arizona. The
project engineer of record was Stadler Consulting Engineers, Inc., Phoenix, Arizona, and
WHEREAS, the Final Plat of Los Lagos, Tract 4096-A, was recorded on August 27, 1991. The
Final Plat of Desert Lakes Estates, Tract 4152-A, was recorded on November 28, 1995. The assurances for
both of these subdivisions are covered under the same agreement and financial account. Article 5.4 of the
Mohave County Subdivision Regulations states: "The duration of the perfon~ance bond or other assurance
shall be for one (1) year from the date of recording. Extensions of Time in one (1) year increments may be
granted by the Board of Supervisors by showing just cause.", and
WHEREAS, previously, the assurance fund for the above-referenced subdivisions also included an
assurance for the completion of improvements for Desert LaJ~es Golf Course and Estates, Tract 4076-C. The
final release of assurances for Tract 4076-C was approved by the Boaxd of Supervisors on June 1, 1998 per
BOS Resolution No. 98-202, and
WHEREAS, the first Extension of Time for the assurance for these subdivisions was granted by the
Board of Supervisors on April 7, 1997, per BOS Resolution No. 97-99. The second extension was granted
February 2, 1998, per BOS Resolution No. 98-51. That extension expires December 20, 1998, and
WHEREAS, since the final release of assurances for Tract 4076-C, the developer has not submitted
any as-built improvement plans for Tract 4096-A, nor for Tract 4152-A. The developer appears to be
making some progress toward the completion of the improvements required for the subdivisions, and
WHEREAS, the outstanding assurance balances as of the latest partial release dated September 24,
1998, are: Los Lagos, Tract 4096-A, $744,756.18; and Desert Lakes Estates, Tract 4152-A, $185,982.20,
and

WHEREAS, at the Planning and Zoning Conmaission meeting on October 14, 1998, the
Commission indicated concern about the lack of completion or lack of apparent progress toward the
completion of outstanding required improvements in Los Lagos, Tract 4096-A, and
WHEREAS, the Public Works Department has commented that the project engineer must submit
a progress report including the amount of improvements completed, the amount of improvements remaining
and an expected date of completion of the improvements, and
WHEREAS, this will be the third Extension of Time for this combined assurance, and
WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
October 14, 1998, the Commission recommended APPROVAL of the Extension of Time for the assurances
for the completion of subdivision improvements for Los Lagos, Tract 4096-A, subject to the following:
1. Tlre developer must, within 90 days of the date of Board approval of this extension, subnrit
to the Public Works Department a progress report prepared by the project engineer, including
a description of the amount of improvements completed in the subdivision, the amount of
improvements remaining, and an expected date of completion of the improvements.
2. The Extension of Time for the assurance for Los Lagos, Tract 4096-A, will be in effect until
April 20, 1999.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 14, 1998, the Commission further recommended APPROVAL of the Extension of Time for the
assurances for the completion of subdivision improvements for Desert Lakes Estates, Tract 4152-A, subject
to the following:
1. The developer must, within 90 days of the date of Board approval of this extension, submit
to the Public Works Department a progress report prepared by the project engineer, including
a description of the amount of improvements completed in the subdivision, the amount of
improvements remaining, and an expected date of completion of the improvements.
2. The Extension of Time for the assurance for Desert Lakes Estates, Tract 4152-A, will be in
effect until December 20, 1999.
WHEREAS, the advertising requirements have been met throughout this subdivision process as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 17, 1998, and posted on October 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 2, 1998, APPROVED these Extensions of Time for the Assurances for the
completion of subdivision improvements for Los Lagos, Tract 4096-A, and for Desert Lakes Estates, Tract
4152-A, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
