HomeMy WebLinkAbout98-402 RESOLUTION NO. 98-402 A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 30-FOOT PORTION OF BERMUDA COURT ADJOINING LOTS 26 THROUGH 48, AND A 30-FOOT PORTION ADJOINING LOTS $$ THROUGH 69, BERMUDA VILLAGE, OF SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1998, a public hearing was conducted to determine whether approval should be granted to abandon the above-described road right-of-way as requested by Rand Holmquist, R.W. Holmquist & Associates of Kingman, Arizona, and WHEREAS, this property is located west of Barrackman Road, approximately one mile south of the Courtwright Road/Highway 95 intersection. The site is accessed from Barrackman Road via west on Village Drive to Bermuda Court. The terrain is flat, sloping slightly toward the southwest. The lots to the west o£ Bermuda Court are vacant. Several lots along the east side of the street are used for commercial purposes, including Hargus Disposal. The center 24 feet (estimated) of the right-of-way is paved. Utility lines appear to be located in the alleyways, and WHEREAS, the Mohave County Public Works Department does not object to the partial roadway abandonment, provided that no lots are denied legal access to Bermuda Court, and WHEREAS, Citizens Utilities Company, Mohave Electric Cooperative and Fort Mojave Tribal Utilities Association do not object to the abandonment. Mohave Electric Cooperative requests that an 8-foot public utility easement be established along both sides of the new right-of-way lines, and WHEREAS, a review of FEMA FIRM Panel #040058-2615C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 98-402 Page 2 WHEREAS, at the public hearing before the Mohave Cotmty Planning amd Zoning Commission on October 14, 1998, the Commission recommended APPROVAL for the Abandonment subject to the following: 1. A 30-foot portion of Bermuda Court adjoining Lots 26 through 48, and a 30-foot portion adjoining Lots 55 through 69, Bermuda Village, will be abandoned as shown in Exhibit "A." 2. Each lot in Bermuda Village will accrue that portion of the roadway directly adjoining its property line unless otherwise specified in Exhibit "A." 3. Written concurrence will be submitted from all affected utility companies. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 17, 1998, and October 24, 1998, and posted October 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1998, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
