HomeMy WebLinkAbout98-403 INDEXED ~,OARO qF SUPERVISORS RECORDING FEE RESOLUTION NO. 98-403 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 10, BLOCK G, GOLDEN SAGE RANCHOS, UNIT 68, IN SECTION 27, TOWNSHIP 22 NORTH, RANGE 19 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/2A (AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by E. Jack and Shirley M. Aiello of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68, between Egar Road and Estrella Road. The site is accessed from State Highway 68 via north on Egar Road to Todilto Drive, then east on Todilto Drive to Eden Road, then north on Eden Road to the site, located on the east side approximately 325 feet north of Todilto Road. The property has a single-family residence on it and the terrain is relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant lots and a few widely scattered single-family residences. There is a small wash crossing the northeast corner of this property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A- R/2A (Agricultural-Residential/Two Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2125C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant envirorm~ental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-403 Page 2 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). Per the Zoning Ordinance, the secondary residence will be used for nonpaying guests and relatives only. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 17, 1998, and posted on October 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
