RESOLUTION NO. 98-404
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NW¼ NW¼, THE S~
NW¼ AND THE NE¼ SW¼ OF SECTION 13, IN TOWNSHIP 22 NORTH, RANGE 20 WEST, FOR
A PRIVATE LANDING STRIP IN A C-RE/36A (COMMERCIAL-RECREATION/THIRTY-SIX
ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at Se regular meeting of the Mohave County Board of Supervisors held on November
2, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Ronald E. Gardner of Golden Valley, Arizona, and
WHEREAS, this property is located north of State Highway 68, west of Bapchule Road, northwest
of the Golden Valley Area. The site is accessed from State Highway via north on Estrella Road to Jurassic
Drive, then *vest on Jurassic Drive approximately 4.8 miles across Bureau of Land Management (BLM) land
to the northeast corner of the property. The property has a single-family residence on it and is being used
as a cattle ranch. The terrain is rolling hills. The runway and ranch complex is located within a valley. The
surrounding land uses consist of vacant BLM land. There are no significant drainage patterns, and
WHEREAS, the applicant requests tiffs Zoning Use Pem~it for a private landing strip in support of
the guest ranch. The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, this property was rezoned to C-RE/36A (Conwaercial-Recreation/Thirty-six Acre
Minimum Lot Size) via BOS Resolution No. 97-391 on November 3, 1997. Condition 2 required the
applicant to obtain a Zoning Use Permit for the private landing strip, and
WHEREAS, a review of FEMA FIRM Panel #040058-2125C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
October 14, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a private landing strip in support of the guest ranch and
activities related thereto.
2. The applicant shall comply with all applicable Federal Aviation Administration (FAA)
provisions and requirements.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
4. The applicant shall apply for permanent right-of-way for the road to this site from the Bureau
of Land Management (BLM). Once this right-of-way has been granted to the applicant, this
right-of-way will have to be assigned to Mohave County in a perpetual manner.
5. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
6. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 17, 1998, and posted on October 16, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 2, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
