AND 92-298 WHICH APPROVED THE REZONE AND THE EXTENSIONS OF TIME FOR THE REZONE OF LOT 13, BLOCK 1, GOLDEN SAGE RANCHOS, UNIT 56, IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 17 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolutions for the Rezone and the Extensions of Time for the Rezone for the above-described property as requested by the Mohave County Planning and Zoning Department. The property owner is Frank and Joyce Patrao of Laguna Hills, California, and WHEREAS, this property is located on the south side of State Highway 68, between Tooman Road and Kaba Road. The site is accessed directly from State Highway 68 to the south. The property is vacant and relatively flat, sloping slightly to the southwest. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to C-2H (General Commercial Highway Frontage) by the Mohave County Board of Supervisors on February 5, 1990, via BOS Resolution No. 90-48. It was first extended on April 1, 1991, with BOS Resolution No. 91-106. It was extended the second time with BOS Resolution No. 92-298 on September 8, 1992. No further Extensions of Time have been requested by the applicant. A letter was sent inforufing the property owner that it would be scheduled for rescission. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. e. None of the Conditions of Approval for the Rezone have been met. f. No further Extensions of Time have been requested by the applicant. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1998, the Commission recommended that BO S Resolution Nos. 90-48, 91-106 and 92-298 be RESCINDED and that the zoning will revert to A-R (Agricultural-Residential). RESOLUTION NO. 98-405 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 17, 1998, and posted on October 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1998, RESCINDED BOS Resolution Nos. 90-48, 91-106 and 92-298 and REVERTED the zoning to A-R (Agricultural-Residential), as reconm~ended by the Mohave County Planning and Zoning Commission and outlined herein.
