HomeMy WebLinkAbout98-406 RESOLUTION NO. 98-406 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 90-316. 92- 38, 93-62, 94-263, 96-45, AND 97-109 WHICH APPROVED THE MONTE CARLO MOBILE HOME PARK PLAN AND THE EXTENSIONS OF TIME FOR THE PARK PLAN AND IMPROVEMENTS ON PARCEL 5, IN THE NW¼ OF SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolutions for the Monte Carlo Mobile Home Park and the Extension of Time for the completion of improvements for the Monte Carlo Mobile Home Park for the above-described property, as requested by the Mohave County Planning and Zoning Department. The property owner is Barbara Marks of Barbara Marks and Associates, Laughlin Management, Tempe, Arizona, and WHEREAS, this property is located north of State Highway 68, between Laguna Road and Teddy Roosevelt Road. The site is accessed directly from State Highway 68. It is located on the northeast corner of the extension of Laguna Road and State Highway 68 intersection, and borders on the south side of Chino Drive. The property is vacant and relatively flat; however, there is a significant wash that crosses the property from the northeast to the southwest, and WHEREAS, this property was conditionally approved for the Monte Carlo Mobile Home Park Plan by the Mohave County Board of Supervisors on November 5, 1990, via BOS Resolution No. 90-316. It was extended for the first time with BOS Resolution No. 92-38 on February 3, 1992. A second extension was granted on March 8, 1993, with BOS Resolution No. 93-62, and a third extension was granted with BOS Resolution No. 94-263 on August 8, 1994, when the applicant was granted a 15-month extension. A fourth extension was granted via BOS Resolution No. 96-45 on February 5, 1996. On April 7, 1997, a fifth Extension of Time was granted with BOS Resolution No. 97-109. A letter was sent informing the property owner that it would be scheduled for rescission. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Ama, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. RESOLUTION NO. 98-406 Page 2 c. The site has legal access. d. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1998, the Commission recommended that BOS Resolution Nos. 90-316, 92-38, 93-62, 94-263, 96-45, and 97-109 be RESCiNDED. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 17, 1998, and posted on October 16, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1998, RESCINDED BOS Resolution Nos. 90-316, 92-38, 93-62, 94-263, 96-45, and 97-109 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
